UPPER OXFORD TOWNSHIP PLANNING COMMISSION
MAY 2, 2005
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Monday, May 2, 2005
Members present: Christine Nibouar, Sam Reyburn, Henry Huber, Harold Bryson and Thomas S. Williams
Others present: Jane Daggett, Betsy Huber, Jim Gordon, Ed Jefferis, Scott and Denise Rugen, Mark Eisenried of PPL Gas Utilities, Ross Unruh, Nina Seidel and Matt Chrobocinski representing the Heritage Building Group, Bruce Bubeck, Francis Sharon, Richard Breckbill, Charles Fleischmann, Bill Schoell, Neil Linkmeyer, Steve Donnelley, Will Hickman and Kera P. Smith.
REUBEN STOLTZFUS – 2 lot subdivision located at Saw Mill Road and Edenton Road presented by Ed Jefferis. Received Chester County Health Department approval. (Form B – Non Building Waiver).
Motion was made by Harold Bryson, seconded by Tom Williams and carried unanimously to approve the John S. and Fannie F. Stoltzfus, 2-lot Final Subdivision Plan, Project No. 0453.
RICHARD ALTIZER – 2 lot subdivision on Muddy Run Road presented by Ed Jefferis. The note regarding the ROW has been added to the plan according to the Solicitor’s wording. Received Chester County Health Department approval. A Sewage Maintenance Agreement between Richard Altizer and Upper Oxford Township will be filed after receiving Solicitor’s approval.
Motion was made by Harold Bryson, seconded by Christine Nibouar and carried unanimously to approve the Richard Altizer, 2-lot Final Subdivision Plan, Project No. 0443.
WILLIAM ST. JOHN – a sketch plan for this property situated at the end of Forest Manor Road was presented by Ed Jefferis. Mr. St. John owns approximately 3.8 acres of property and would like to subdivide into two lots. (Zoning is R-2 which allows one acre in this district) Each lot would have road frontage of at least 50’. The road ends at this property and Mr. St. John would be willing to put in a cul de sac and dedicate it to the Township. The ground which the trailers are on however would not be able to subdivide.
BARTELS/HICKMAN – 81 lot subdivision along Route 896. Ross Unruh, Nina Seidel and Matt Chrobocinski were present to represent the Heritage Building Group. Henry informed Mr. Unruh that the township is very skeptable about the drip, irrigation system since no one on the Planning Commission or Board of Supervisors are qualified to review such a system. However, the Supervisors are in the process of hiring a sewage expert or consultant to represent the township in this matter and hope to appoint a consultant at the May 9, 2005 meeting. Heritage Building Group will send an extension letter to the Board of Supervisors meeting and will return to the Planning Commission next month.
NEIL LINKMEYER – 2 lot subdivision, add-on for premises situate at Cullen Road. Mr. Linkmeyer presented the Planning Commission with a sketch plan whereby he would sell approximately one acre of his property to his neighbor. Mr. Linkmeyer would still have approximately 2 ½ acres remaining and his neighbor would have approximately 2 acres total. (his neighbor presently has a non-conforming lot) Mr. Linkmeyer was informed that he would have to hire a engineer to draw up formal plans and return to the Planning Commission.
COMMONWEALTH LAND AND INVESTMENT – sketch plan for 11 lot subdivision along Route 10 and Penns Grove Road
A revised sketch plan was received from Commonwealth Land and Investment Co. However, there was no one present to represent Commonwealth.
EXTENSIONS – Motion was made by Henry Huber, seconded by Christine Nibouar and carried unanimously to instruct the Secretary to contact Michael Pelet and also the Community of Love Lutheran

Church to request an extension of time for their subdivisions, if not granted then recommending to the Supervisors that the subdivisions be rejected.
The Planning Commission discussed the R-1 District, Section 403 and the R-2 District, Section 502, in the zoning book. Motion was made by Henry Huber, seconded by Tom Williams and carried unanimously to have the engineer address the following sections:
Section 403. A.3.a.ii, to read as follows:
“Permitted residential lots with on lot water and public or community sewer”
Section 502.B to read as follows:
“All permitted residential uses served with individual water services and community
or public sewers”
ADJOURNMENT – There being no further business, motion was made by Tom Williams, seconded by Harold Bryson and carried unanimously to adjourn at 8:45 P.M.
