UPPER OXFORD TOWNSHIP PLANNING COMMISSION
SEPTEMBER 6, 2005
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Tuesday, September 6, 2005.
Members present: Sam Reyburn, Henry Huber and Thomas Williams (absent were Christine Nibouar and Harold Bryson)
Others present: Jane Daggett, Betsy Huber, Nathan King, Linda and Dennis Peterson, Judy Parry, Steve Donnelley, Will and Kera Smith, Carol Stanley, Joshua Stanley, Cassie Brinn, John Coldiron, Wayne Megill, Julie Kirkpatrick, Charles Fleischmann, Jim Fritsch and John Pogue
WILLIAM AND MARGARET SHAW – 42 Lot Sketch Plan on Route 896, below Rt. 131. This plan was presented by Jim Fritsch of Regester Associates along with Wayne Megill. The property consists of 5 parcels, approximately 108 acres along Route 896. Properties are in Upper Oxford Township, a small portion in Lower Oxford Township and also Penn Township. The property will have 40 homes with public water supplied by Chester Water Authority and on site sewage. The existing structures will remain on Lot 41 which is 53 acres . Lot 42 is not to be considered as a separate building lot. Proposed Open Space, consisting of 2.121 acres will have a Sewage Disposal Area for Lots 13, 16, 17, 18, 19 with replacement area for Lot 15 and 20. The other Proposed Open Space, consisting of 1.000 acre will have a Sewage Disposal Area for Lots 5 and 6 and replacement for Lot 7. While the Planning Commission thought the design of the subdivision was appealing, they stressed that the planner re-do the sewage system and have on site sewage for all lots.
KING/BEILER – 29 Lot Sketch Plan on Route 896 near University Road. This plan was presented by Julie Kirkpatrick. The property consists of 2 parcels, approximately 70 acres in the R-1 District. The plan has 32 lots which includes the present farm house and buildings. The plan proposes a community sewage system. The Planning Commission concerns were with the maintenance of the storm water systems in the boulevard and the circle areas and also the upkeep of the plantings in the boulevard.
CAROL STANLEY – 2 Lot Sketch Plan on Pusey Mill Road. This plan was presented by Mrs. Stanley’s son, Joshua Stanley. The property consists of approximately 4.5 acres. The current house is in the front of the property. The subdivided second lot would be a flag lot and will need a 50’ ROW.
JAMES LEES/FORESTVILLE BUSINESS CENTER – Lot 3 presented by John Pogue of Lake, Roeder and Hillard. The Planning Commission reviewed Ragan Engineering letter with Mr. Pogue and informed him that the township needs to see a copy of the NPDES permit for Lot 3. (NPDES permit was issued with the wrong name on it.)
LINDA PETERSON/ALBERT TALLEY – 3 Lot Subdivision on Spring Valley Road presented by Judy Parry of Concord Land Planners. Approval was received from Chester County Health Department.
Motion was made by Henry Huber, seconded by Tom Williams and carried unanimously to approve the Linda Peterson/Albert Talley, 3-Lot Subdivision Plan, Project No. 0511.
THOMAS MCQUEEN – 2 Lot Subdivision on Ewing Road. All fees have been paid and plans were forwarded to Chester County Health Department and Chester County Planning Commission for review.
ZONING CHANGE – An ordinance to amend the zoning map along Route 10 at the Upper Oxford Township/West Fallowfield Township border was reviewed along with Composting definitions and regulations in the L-I Zone.
Motion was made by Henry Huber, seconded by Tom Williams and carried unanimously to recommend to the Board of Supervisors that they adopt Ordinance #2-2005.

JUNK YARDS – Motion was made by Henry Huber, seconded by Tom Williams and carried unanimously to recommend to the Board of Supervisors that junk yards be on a minimum of twenty-five (25) acres in the L-I District.
AUTO BODY REPAIR ORDINANCE – was presented to the Planning Commission for their review.
ADJOURNMENT – There being no further business, motion was made by Henry Huber, seconded by Tom Williams and carried unanimously to adjourn at 9:00 P.M.
