UPPER OXFORD TOWNSHIP PLANNING COMMISSION
MARCH 6, 2006
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Monday, March 6, 2006.
Members present: Christine Nibouar, Sam Reyburn, Thomas Williams, Harold Bryson and new member, Karl Herr.
Others present: Jane Daggett, Betsy Huber, Ed Jefferis, Marty and Hank Detering, Julie Kirkpatrick, Steve Donnelley, Joe and Louise Cappelli, Mike Ridgley, Charles Fleischmann, Douglas Randolph, K. Stephens, Bill Shaw, Peg Shaw, Jim Gordon, Andrea Rau, Jim Jenerosa and Phil Barba
The meeting was called to order at 7:30 P.M. by Chairman, Christine Nibouar. Christine welcomed new member, Karl Herr who will serve a 2 year term. Christine also stated that the Planning Commission is here to uphold and abide by the Upper Oxford Township Subdivision and Land Development Ordinance and Zoning Ordinances.
MICHAEL PELET, n/k/a GEORGE KIRIAKIDI – 11 Lot Final Subdivision Plan on University Road. Ed Jefferis from Concord Land Planners was present to request a waiver regarding the diameter of pipe to be used for the storm water.
Motion was made by Sam Reyburn, seconded by Tom Williams to recommend to the Board of Supervisors to waive ordinance requirements and allow that a 12” diameter HDPE pipe be used. MOTION CARRIED.
HARTMAIER/PENNS GROVE ASSOCIATES – 11 Lot Preliminary Subdivision Plan on Penns Grove Road. This plan was presented by Attorney Andrew Rau along with Jim Jenerosa and Phil Barba. A portion of this plan is located in Lower Oxford Township. All fees have been paid and plans have been forwarded to Chester Co. Planning Commission, Chester Co. Health Department and the township engineer for review.
The Planning Commission voiced their concerns regarding the open space and storm water management. Mr. Barba explained that an easement would be on each lot to allow and developer or township to monitor storm water. This will be recorded on the subdivision plan. We will wait to receive the reviews from the engineer and will discuss storm water in more detail at that time.
WIGGING/MEGILL HOMES – 16 Lot Preliminary Subdivision on Pusey Mill Road known as “Bainbridge” subdivision. This plan will require an extension from the Board of Supervisors March 13th. There was no activity this month, waiting for reviews to come back.
JOSEPH CAPPELLI – 23 lot sketch plan on Ewing Road. Mr. Cappelli submitted a sketch plan at the February 2006 meeting along with a check for $4,600.00. An application form for the Township and also a form for the County was received February 9th. No studies or planning modules were presented. The Planning Commission will seek the advice of the township solicitor regarding the submission of this plan.
KINGS MILL I – 32 Lot Preliminary Subdivision Plan on Newark Road presented by Julie Kirkpatrick of Lake, Roeder and Hillard. Julie informed the Planning Commission that they met with the township engineer and also one of the township supervisors to discuss certain items. Will discuss areas of concerns with the Board of Supervisors also. Waiting for reviews.
KINGS MILL II – 38 Lot Preliminary Subdivision Plan on Newark Road presented by Julie Kirkpatrick. This plan has added additional property belonging to the Sheltons and will be entirely separate from Kings Mill I. At a later date, the developer will decide which plan to follow through with. All fees have been paid and the plans have been forwarded to Chester Co. Planning Commission and Chester Co. Health Department and also to the township engineer for review.

Christine informed Julie that a few residents were present and had concerns regarding this subdivision. Mile Ridgley discussed his concerns with the water running across Route 896 onto his property. Also construction traffic and keeping the roadway cleaned at the construction entrance. Additionally, he would like to see trees of 3” diameter and not 2”. Steve Donnelley questioned Julie on the drip irrigation system. Julie stated that she would note all concerns and see if answers can be given next month. Christine discussed the possibility of the planning commission, engineer and developer meeting on site for an inspection. Julie will schedule this.
ALFRED FORTUGNO/MALLET HILL ESTATE – 77 Lot Preliminary Plan presented by Julie Kirkpatrick. Julie explained that she was filling in for someone else on this project. This property is located on the corner of Ewing and Forest Manor Roads. All fees have been paid and plans were forwarded to Chester Co. Planning Commission and Chester Co. Health Department for review and also to the township engineer. A majority of the property will accommodate a drip system with a few remaining lots, an on site system. Mr. and Mrs. Henry Detering were present and voiced their concerns regarding the storm water management, destroying the woodlands, building on prime soils and open space use. Mrs. Detering also spoke on behalf of Londonderry Township and as a member of the Elk Creek Water Shed with concerns. Christine would like the Planning Commission to do an on-site inspection of this property also. Julie will arrange this.
KARL HERR – 2 Lot Subdivision and Add-on Plan on Old Limestone Road.
Waiting for reviews.
SEWAGE CONSULTANT – Motion was made by Tom Williams, seconded by Harold Bryson to request that the Board of Supervisors consider an evaluation of a sewer consultant to determine the feasibility of drip systems. MOTION CARRIED.
ENGINEER – Motion was made by Christine Niboaur, seconded by Sam Reyburn to recommend to the Board of Supervisors that the township engineer, Ron Ragan attend the Planning Commission meetings.
MOTION CARRIED.
ADJOURNMENT – Motion was made by Harold Bryson, seconded by Tom Williams and carried unanimously to adjourn at 8:50 P.M.
