UPPER OXFORD TOWNSHIP PLANNING COMMISSION
APRIL 3, 2006
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Monday, April 3, 2006.
Members present: Christine Nibouar, Sam Reyburn, Thomas Williams, Harold Bryson and Karl Herr
Others present: Jane Daggett, Nina Seidel, Gia Raffaelli, Ross Unruh, Bill Shaw, Peg Shaw, Phil Barba, James Generosa, Fran Sharon, William Conver, Charles Fleischmann, Jim Gordon, Steve Donneley, Kera Smith, Laura Swiski, Martha and Henry Detering
The meeting was called to order by Chairman, Christine Nibouar. Christine explained to the audience that the Planning Commission and the Board of Supervisors met with representatives from Castle Valley Consultants, Inc.
Motion was made by Tom Williams, seconded by Harold Bryson to recommend to the Board of Supervisors to obtain Castle Valley Consultants as a resource to review all sewage modules. MOTION CARRIED.
WILLIAM AND MARGARET SHAW/CHADDS FORD BUILDERS – 37 Lot Preliminary Subdivision on Newark Road. All fees have been paid and plans have been forwarded to Chester Co. Planning Commission and Chester Co. Health Department for review. This parcel is in the R-3 zoning and currently has two existing homes along with a barn and a shed. The developers are proposing 36 new lots, with the remaining lot being retained by the owners. The township engineer’s review letter was reviewed and areas discussed are as follows:
B.2 – This item can be removed if other items are satisfied such as good septic, note on plan preventing further subdivision
B.3 – Dwelling placement is adequate where it is
B.5 – Ordinance requires light fixtures – developer will comply
C.1 – Developer requesting waiver – township and developer can compromise and note where trees would be removed
D.9 – Deed restricting Lot 37 against further subdivision (Megill and Mr. Shaw will discuss this)
D.21 – Chester Water Authority – has ability to service this property
E.12 – Use of curbing – applicant is proposing rolled concrete curbs on advice of township engineer – Road Master will be contacted for his recommendations also
F.3 – Developer would like this deferred to final plan. Township engineer and Planning Commission Members requesting submission to Conservation District in preliminary stages.
G.1 – Developer will submit revised plans to Lower Oxford Township and Penn Township
Developer will have replacement sites put on plans for Lots 18 and 20
Developer will have survey crew put stakes in where road will go.
Township Engineer suggested that developer obtain the Route 896 Corridor Study and incorporate into plans.
HARTMAIER/PENNS GROVE ASSOCIATES – 11 Lot Preliminary Plan on Penns Grove Road.
James Generosa, Phil Barba and Bill Conver were present to discuss the township engineer’s review letter:
C.7 - Requesting waiver for street profiles – formal waiver should be noted on plan
C.6 - Wetlands should be noted on plan – no wetlands in Upper Oxford Township
C.4 - Responsibility of storm water – Lot owners
C.10 – Location and elevation of street monuments – will be shown on “as built plans”
C.15 – Impact Section of zoning ordinance – Ron will fax them a copy
Cartway width should be consistent with Lower Oxford
E & S plan should be done at Preliminary stage of subdivision
Complete set of plans should be given to both Upper Oxford Township and Lower Oxford
Township.
HICKMAN/HERITAGE BUILDING GROUP – 2 Lot Preliminary Subdivision Plan presented by Ross Unruh. Approximately 3.42 acres parcel is being subdivided from the original 27.37 acres parcel which is currently under review for a 81 lot subdivision. The 3.42 parcel will be retained by the Hickman’s and will be deed restricted and be “open space”. The Planning Commission had some questions regarding the open space and will refer to the township solicitor for clarification.
KING MILL II – 38 Lot Preliminary Subdivision between Route 896 (Newark Road) and Pusey Mill Road. Laura Swiski was present to review the township engineer’s letter. A site meeting will be scheduled for the Planning Commission along with the township’s engineer and applicant’s engineer to view the property. Ownership of the Open Space will be retained by the existing owner in agricultural and will be deed restricted against further subdivision. Entrance at Pusey Mill Road was discussed along with the diameter of trees and also if the township still wanted a boulevard into the subdivision. Additionally, Ron Ragan encouraged Ms. Swiski to review the Route 896 Corridor Study and incorporate into the plans. The township roadmaster will be contacted for his concerns regarding the boulevard.
MALLET HILL ESTATES/ALFRED FORTUGNO – 77 Lot Preliminary Subdivision Plan. The amount of lots on a cul de sac was discussed and the possibility of allowing 4 extra lots if a waiver could be obtained from the supervisors. The development proposes all on-lot wells and a drip system for most of the development. The Planning Commission and developer will schedule an on-site visit for the end of April. Mr. and Mrs. Detering voiced their concerns regarding the drainage field and also the storm water discharge onto his property. Mr. Detering also requested the Planning Commission to restrict Mr. Fortugno from selling the remaining property as a Polo Club.
KARL HERR – 2 Lot Subdivision – No Activity this month.
LINDA PIERCE – 2 Lot Subdivision. No discussion on this. Will wait until next month.
Tom Williams suggested that the township purchase an easel to use during the meetings.
ROUTE 896 CORRIDOR STUDY – The Planning Commission will review the draft of the 896 study and take their comments to the 896 Task Force.
Tom Williams informed the Planning Commission that he would be resigning in June and will send a formal letter to the township.
BARTELS/HICKMAN – 81 Lot Subdivision – An update and progress of the subdivision plan was given by the township engineer, Ron Ragan to the audience.
ADJOURNMENT – There being no further business, Motion was made by Harold Bryson, seconded by Tom Williams and carried unanimously to adjourn at 9:30 P.M.
