UPPER OXFORD TOWNSHIP PLANNING COMMISSION
June 5, 2006
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Monday, June 5, 2006.
Members present: Christine Nibouar, Sam Reyburn, Harold Bryson and Karl Herr and township engineer, Ronald Ragan
Others present: Jane Daggett, Charles Fleischmann, Blair Fleischmann, Kera Smith, Fran and Frannie Sharon, William Shaw, Jim Fritsch, Jim Gordon, Steve Donnelley and Laura Swiski
ESTATE OF KATHLEEN JEFFORDS – 2 Lot Subdivision and add-on plan on Newark Road. This plan was presented by Jim Fritsch of Regester Associates. The property is approximately 309 acres and is presently in three parcels. This plan would change the property to be two parcels. One parcel will be in Upper Oxford Township, Chester County and the other parcel would be in Salisbury Township, Lancaster County. The center of the creek would be the property line. In the event that the course of the creek changes throughout the years, the line would still be the center of the creek. Mr. Fritsch will be seeking four waiver from the Board of Supervisors, as follows:
Section 501.K.1.b Requiring 5 foot contours
Section 501.K.5 Requiring steep slopes to be delineated
Section 501.K.6 Requiring location of trees 6 inches or greater
Section 501.K.7 Requiring the location of wetlands
Additionally, we are still waiting for the Chester County Health Department review of the Form B – Non-Building Waiver.
Motion was made by Karl Herr, seconded by Harold Bryson and carried unanimously to approve this 2-Lot Subdivision Plan contingent on Chester County Health Department approval. MOTION CARRIED.
HICKMAN/HERITAGE BUILDING GROUP – 2 Lot Final Subdivision Plan on Baltimore Pike. This plan was approved by the Planning Commission at the May 1, 2006 meeting, therefore it was appropriate to sign the plans. Planning Commission signed 12 copies of the subdivision plan.
BRENDAN DOUGHERTY – 2 Lot Subdivision Plan. Upper Oxford Township Planning Commission and Board of Supervisors waived the review process of this plan since most of the property was located in Lower Oxford Township. The township of Lower Oxford approved this plan by Resolution at their last month’s meeting. Upper Oxford Township Planning Commission signed 12 plans.
MALLET HILL ESTATES/ALFRED FORTUGNO – 77 Lot Preliminary Subdivision on Ewing and Forest Manor Road. The review of the sewage facilities planning module was received from our consultant, Castle Valley. Laura Swiski was present to discuss the possibility of a site-walk in October if agreeable to the Planning Commission. Laura also discussed with the members the possibility of Mr. Fortugno revising his subdivision plan to include all on-site septic systems instead of the community system. If this should happen, a new sewage module will be sent to Castle Valley for review by request of the Planning Commission.
KINGS MILL I – 32 Lot Preliminary Subdivision Plan on Newark Road was discussed. This plan will need an extension for next month. Laura Swiski informed the members that she would get an extension by then or submit a letter to formally withdraw this plan since Kings Mill II is still being processed.

KINGS MILL II – 38 Lot Preliminary Subdivision Plan on Newark Road. We are waiting for Chester Co. Health Department comments and review on this plan. Additionally, review of the sewage facilities planning module was received from Castle Valley. The boulevard in the subdivision was discussed again. Planning Commission has some concerns with the center portion of the boulevard and also the maintenance of the ponds. Ron Ragan, township engineer, gave the Planning Commission some places to go to view different curbing used in developments.
SHAW/CHADDS FORD BUILDERS – 37 Lot Preliminary Subdivision Plan on Newark Road. Will need extension for Board of Supervisors meeting. Ron Ragan explained to Mr. Shaw some of their findings from the “site-walk” such as Rt. 896 will need to have a de-cel lane, the entrance to the barn area will probably be changed to come out on the new road. Additionally, the review from Castle Valley regarding the sewage module was discussed.
LINDA PIERCE – 2 Lot Subdivision Plan on Pennsgrove Road. We are waiting for Chester County Health Department review. Additionally, this plan will need an extension for the Board of Supervisors meeting.
PENNS GROVE ASSOCIATES/HARTMAIER – 11-Lot Preliminary Subdivision Plan on Pennsgrove Road. – No Activity This Month
BARTELS/HICKMAN/HERITAGE BUILDING GROUP – 81-Lot Preliminary Plan – No activity this month, still waiting for DEP reviews.
BAINBRIDGE/WIGGINS – 16-Lot Preliminary Subdivision plan on Pusey Mill Road – Will need extension for Board of Supervisors meeting. Still waiting for review from Chester County Health Department.
MICHAEL PELET, n/k/a GEORGE KIRIAKIDI – 11-Lot Final Subdivision Plan on University Road. This subdivision is waiting for DEP approval. A 180 day extension was granted at a special meeting by the Board of Supervisors held on May 1, 2006.
Next month’s meeting will be held on Monday, July 3, 2006 at 7:30 P.M. Christine will contact Castle Valley to invite their attendance and Ron Ragan will contact the developers and have them attend so that the sewage modules can be discussed.
ADJOURNMENT – There being no further business, motion was made by Harold Bryson, seconded by Sam Reyburn and carried unanimously to adjourn at 9:15 P.M.
