UPPER OXFORD TOWNSHIP PLANNING COMMISSION
July 3, 2006
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 p.m. on Monday, July 3, 2006.
Members present: Christine Nibouar, Sam Reyburn, Harold Bryson, Karl Herr, and township engineer, Ronald Ragan.
Others present: Tom Kelso, Betsy Huber, Bill Shaw, Charles Fleischmann, Luke Allen, Martha Detering, Henry Detering, Bill Lucas, Steve Donnelley, Paul Brousseau, Anne Lambert, Jim Gordon, Laura Swiski, Spence Andress, Paul White, Nina Seidel, Chris Brinton, Lisa Brinton, Jim Fritsch, and Blair Fleischmann.
Tom Kelso, with Castle Valley Consultants, reported on the review of the sewage facilities planning modules for the pending subdivision plans; Kings Mill I &II, Shaw, & Mallet Hill. Tom Kelso acknowledged the proposed on-lot systems for the Shaw property, but also included the Heritage subdivision in his recommendation for a technical discussion to consider the wastewater disposal needs for the broader area of the township with these package treatment plant proposals. Since there are not enough details provided in the applications to make related decisions, he asked the developers to look at other options, such as but not limited to, one system. He would also like for consideration of the needs of the existing homes in the area near these additional wastewater proposals. Tom Kelso referenced the DEP’s review process requirement to include the greatest deficiency alternatives and stated his concern to consider the long term viability for the township, both financially and environmentally.
Ron Ragan added that more ownership and financial information was needed from the developers as the township waits for responses on the outstanding review letters. Jim Fritsch spoke to the Shaw application and the effort to address a letter listing deficiencies, thinking they were on the right track. Tom Kelso commented that the background issue with DEP was high nitrogen levels. Ron Ragan spoke again of the alternative evaluation section. Nina Seidel, representing the Heritage subdivision, stated that the township already signed off on their application which has since been submitted to DEP. Her concerns had to do with the timing of the other subdivisions, as well as coordination with the agreement with Aqua PA. When asked if their sewage module has been submitted to Castle Valley, the response was that changes were being made to address DEP’s letter from months ago. Laura Swiski responded that both Kings Mill and Mallet Hill would be willing to meet for a technical discussion. Ron Ragan will schedule this meeting for technical discussion as recommended by Castle Valley Consultants.
CHRISTOPHER AND LISA BRINTON of Pusey Mill Road provided a sketch plan involving a subdivision from their 7 acre parcel(s) which did not comply with the Flag Lot Zoning Ordinance.
CHRIST STOLTZFUS - 2-lot subdivion plan on Homeville Road was addressed by Bill Lucas of Concord Land Planners. The exhibit from the zoning hearing board and the solicitor’s decision from the conditional use hearing were not available. Additionally, the plan was not signed by the property owner.
VINCENT TALIERCIO – Plans for this 2-lot subdivision on Webb Road were not delivered to the township as anticipated by Bill Lucas.
JOHN ST JOHN – 3 lot subdivision plan on Forest Manor Road was addressed by Bill Lucas but was tabled because of lack of information. Plans have also not been signed by the property owner.
LINDA PIERCE – Concord Land Planners is addressing Ron Ragan’s review letter for this 2-lot subdivision plan on Penns Grove Road. Plans have not been signed by the property owner.
PAUL BROUSSEAU & ANNE LAMBERT requested confirmation of their 50’ right of way from the Kings Mill subdivision. Laura Swiski was able to indicate where the right of way is documented on the subdivision plans.
Paul Brousseau & Anne Lambert also raised questions about the township’s ordinance(s) pertaining to composting. The citizens were directed to the township supervisors.
SHAW & CHADDS FORD BUILDERS – 37 lot subdivision plan on Newark Road is waiting for letter from Chester County Health Department. Ron Ragan mentioned consideration of the farm entrance being combined with the new lower entrance and the possibility of the McGill property being used for a deceleration lane.
FORTUGNO / MALLET HILL – 77 lot subdivision on Ewing and Forest Manor Roads. Laura Swiski spoke to Mr. Fortugno since last month’s meeting and he is in agreement with extending the site visit until after crop season.
KINGS MILL I – 32 lot preliminary subdivision plan on Newark Road. No update.
KINGS MILL II – 38 lot preliminary subdivision plan on Newark Road. No update.
BAINBRIDGE / WIGGINS / MCGILL – 16 lot preliminary subdivision plan on Penns Grove Road. No update.
PELET / KIRIAKIDI – 11 lot final subdivision plan on University Road. No update.
BARTELS / HICKMAN & HERITAGE BUILDING GROUP– 81 lot preliminary plan. No update this month. Steve Donnelly asked if the DEP review letters were available. Ron Ragan has received a copy of the DEP checklist letter of completion of application, but has not received a copy of a DEP technical review letter.
ADJOURNMENT – There being no further business, motion was made by Harold Bryson, seconded by Sam Reyburn and carried unanimously to adjourn at 8:55 p.m.
