UPPER OXFORD TOWNSHIP
DECEMBER 4, 2006
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Monday, December 4, 2006.
Members present: Christine Nibouar, Sam Reyburn, Betsy Huber, Karl Herr, Harold Bryson and township engineer, Ronald Ragan.
Others present: Jane Daggett, Jim Gordon, Charles Fleischman, Fran and Francis Sharon, Jim Fritsch, Ed Jefferis, Marty and Henry Detering, Bill Schoell, David Underwood, Steve Donnelley, Ken Cummins, Philip Barba and Gian Singla
WIGGINS/MEGILL – BAINBRIDGE – 16 Lot Subdivision was presented by Jim Fritsch. The letter of recommendations received from the township engineer was discussed.
Motion was made by Betsy Huber, seconded by Harold Bryson and carried that the Planning Commission has reviewed the layout and location of any soils outside of the designated open space. (A.3 of letter referring to Section 403.A.4.a.iii of Ordinance) MOTION CARRIED
Motion was made by Karl Herr, seconded by Harold Bryson and carried that the Planning Commission is satisfied with the basin location and design. MOTION CARRIED (A.4 of letter)
Additionally, the Planning Commission agreed with the engineer’s recommendation that a jurisdictional determination should be obtained by an independent wetlands consultant selected by the Township. The engineer for the applicant agreed to this condition also.
Motion was made by Karl Herr, seconded by Sam Reyburn with Harold Bryson opposing, to approve the Preliminary Subdivision Plan of the Wiggins/Megill tract contingent upon the open questions in the engineer’s review letter being resolved. MOTION CARRIED
MICHAEL PELET/GEORGE KIRIAKIDI – 11 Lot Final Subdivision Plan on University Road presented by Ed Jefferis. Outstanding items were discussed by Ed and the Planning Commission.
Motion was made by Sam Reyburn, seconded by Betsy Huber to approve the Michael Pelet, now know as George Kiriakidi Final Subdivision Plan contingent on receiving the following:
D.E.P. review and approval
Escrow amount being received by the Board of Supervisors and approved by the Solicitor
Signed and notarized subdivision plan.
MOTION CARRIED.
PENNS GROVE ASSOCIATES – 11 Lot Preliminary Subdivision Plan was presented by Philip Barba and Gian Singla. The township engineer’s letter was discussed. Some of the items that still need to be resolved are as follows:
Signatures
Wetlands delineation and jurisdictional determination report
Waiver for profiles
Waiver for curbing
Storm water needs to be reviewed
Lower Oxford Township approval of the plans

Motion was made by Karl Herr, seconded by Betsy Huber with Harold Bryson opposing and Sam Reyburn abstaining, granting Preliminary Approval of the Penns Grove Associates 11 Lot Subdivision Plan contingent on all outstanding items being addressed and resolved. MOTION CARRIED.
KEN CUMMINS – presented a sketch plan of his property which consists of approximately 10.8 acres along Ewing Road. Mr. Cummins would like to subdivide 4 acres from the present parcel. The Planning Commission saw no problems with this.
LIGHTING ORDINANCE – The township engineer is still working on this
SUBDIVISION EXPIRATION DATES – Were reviewed by the Planning Commission
AG ZONING ORDINANCE – Amended ordinance was received from the Solicitor. The Planning Commission will review and discuss this at a later date.
ADJOURNMENT – Motion was made by Harold Bryson, seconded by Karl Herr and carried to adjourn at 9:15 P.M.
The January meeting will be held Tuesday, January 2, 2007 in the lower level of the building.
