UPPER OXFORD TOWNSHIP PLANNING COMMISSION

JANUARY 2, 2007

 

               The Upper Oxford Township Planning Commission held its reorganization meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Tuesday, January 2, 2007.

 

               Members present:  Christine Niboaur, Sam Reyburn, new member, David Underwood, Harold Bryson and Karl Herr

 

               Others present:  Jane Daggett, Betsy Huber, Charles and Blair Fleischmann, Steve Donnelley, Ed Jefferis, Carol Stanley and Dave Rentschler.

 

TEMPORARY CHAIRMAN – Motion was made by Christine Nibouar, seconded by Harold Bryson and carried to appoint Sam Reyburn as Temporary Chairman

 

ELECTION OF OFFICERS

 

 Motion was made by Harold Bryson, seconded by Dave Underwood and carried to appoint Christine Nibouar as Chairman.

 

               Motion was made by Karl Herr, seconded by Christine Nibouar and carried to appoint Sam Reyburn as Vice-Chairman.

 

               The regular meeting commenced.

 

JOHN ST. JOHN – Ed Jefferis reviewed this subdivision plan with the Planning Commission and brought them up to date on where this plan was regarding permits and planning module.  Location of the trees still needs to be shown on the plan.  Linda Pierce, neighboring property owner, will also need to sign the plans because of the cul de sac.  Ed will return next month seeking final approval.

 

CAROL STANLEY – 2 Lot Subdivision on Pusey Mill Road.  This plan was presented by Dave Rentschler of Commonwealth Engineers.  All fees have been paid except for an engineering fee which will need to be paid.  Plans were sent to Chester County Planning Commission, Chester County Health Department and township engineer for review.  This property had hearings for Conditional Use and also a Zoning Hearing.  Decisions were in favor of the applicant.  The applicant is proposing to place an additional dwelling behind the present home.  Mrs. Stanley will retain ownership of both lots and maintain the driveway.  Planning Commission had some concerns with the present driveway and also the right of way on the flag lot.  Will seek the advice of the solicitor.

 

BINDLEY AND OBER LAND DEVELOPMENT PLAN – This plan was looked at briefly.  No representation by the applicants was available at this meeting.

 

SHAW PROPERTY – This property was discussed by the Planning Commission.  Areas of concern are the road coming out onto Route 896.  However, this Preliminary Plan was approved by the Planning Commission November 6, 2006 and the Board of Supervisors December 11, 2006.  Additionally, this is a state road so permits will need to be issued by Penn Dot after their review.

 

EFFECTIVE AG ZONING – Was discussed by the Planning Commission members.  Items of concern were Section 402. 

 

               Motion was made by Sam Reyburn, seconded by Karl Herr and carried to recommend to the Board of Supervisors to adopt the latest version of the amended effective ag zoning dated December 8, 2006.  Harold Bryson – opposed, and David Underwood – abstained.

ADJOURNMENT – There being no further business, motion was made by Karl Herr, seconded by Christine Nibouar, and carried unanimously to adjourn at 8:50 P.M.
