UPPER OXFORD TOWNSHIP PLANNING COMMISSION
AUGUST 6, 2007
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Monday, August 6, 2007.
Members present: Sam Reyburn, David Underwood, Harold Bryson, Karl Herr, township engineer, Ron Ragan and township secretary, Jane Daggett

RICK RETTIG PLANNING MODULE – Mr. Rettig is building a second home on an agricultural property, therefore, the Chester County Health Department and DEP are requiring a planning module. The Planning Commission reviewed the module and would like to see the Bureau of Forestry, “pending clearance” before acting on this module. This will be looked at again next month.
PETTINARO SHOPPING CENTER – Mr. Pettinaro and Mr. Riper presented a plan for a shopping center to be situated at the southwest corner of the Route 1 By-pass and Route 896. This property is zoned C-2. Some items in our zoning needs clarification and also Mr. Pettinaro is requesting some zoning changes in order for him to be able to proceed with a center. Three of the main issues are as follows: the size of the building – would like it changed from 40,000 square feet to 55,000 square feet, paved area – from 50% to 75%, and also the signage – would like 2 free standing signs with band signs on the main signs. Approximately ten (10) other items mainly need clarification: building height, steep slopes, stripping of top soil, lighting, noise control, heat and glare, off street loading, parking requirements, historic resources. Mr. Riper explained that the septic will be off site and water will be received from Chester Water Authority. After much discussion, a vote was taken to go forward with the Board of Supervisors with changes to the zoning for the Pettinaro request. Sam – yea, Harold – yea, Karl – yea, Dave – no. MOTION CARRIED.
WIGGINS/BAINBRIDGE/MEGILL - Final 16 Lot Subdivision Plan on Pusey Mill Road - The township has received approval from Chester County Health Department on the Planning Module. This module was reviewed by the Planning Commission last month. We have received an adequate letter from the Chester County Conservation District and a copy of the traffic study letter. Outstanding items are receiving the Storm Water NPDES permit and also approval from DEP for the Planning Module.
Motion was made to recommend to pass on the final subdivision plans to the Board of supervisors to give final approval with conditions. Sam – yea, Dave – yea, Harold – yea, Karl – yea. MOTION CARRIED.
SHAW/RIDINGS/MEGILL – Final 37 Lot Subdivision Plan on Newark Road. The Township has received Chester County Health Department approval and also an adequate letter from Chester County Conservation District. There are still outstanding issues on the final subdivision plan. The Planning Commission however, reviewed the Planning Module for completeness.
BARTELS/HICKMAN - HERITAGE BUILDING GROUP – Final 81 Lot Subdivision along route 896. This property will have public water and a drip field for septic which will be taken by Little Washington Wastewater Company. Heritage has submitted an application to Penn Dot for the intersection improvements and signal review. Additionally, they have submitted a revised Planning Module to DEP. The Home Owners Association will oversee the operation and maintenance of basins and drip fields. The roads will be dedicated to the township. Since there are still outstanding items to be addressed, Heritage will return next month.

RANDY MARTIN – Interested in purchasing the Hartshorne property on Ray Mar Road. This property was subdivided into four lots previously in 1992. The Martins were told that the subdivision was reversed. The Planning Commission advised them to go to the Recorder of Deeds to check into this further.
ACT 537 PLAN – which Castle Valley Consultants has been working on was discussed. Motion was made by Dave Underwood, seconded by Harold Bryson and carried to recommend to the Board of Supervisors that they adopt the Castle Valley water and wastewater standards. Sam – yea, Dave – yea, Harold – yea, Karl – yea. MOTION CARRIED.
ADJOURNMENT – There being no further business, motion was made by Sam Reyburn, seconded by Harold Bryson and carried to adjourn at 10:10 P.M.
