UPPER OXFORD TOWNSHIP PLANNING COMMISSION
SEPTEMBER 4, 2007
The Upper Oxford Township Planning Commission held its regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA at 7:30 P.M. on Tuesday, September 4, 2007.
Members present: Christine Nibouar, Sam Reyburn, Harold Bryson, Karl Herr, township engineer, Ron Ragan and township secretary, Jane Daggett
Others present: Ed Jefferis, Spence Andress, Frances Reyburn, Jim Fritsch, Fran and Frannie Sharon, Chris and Sarah Coburn
RICK RETTIG PLANNING MODULE – This module was reviewed by the Planning Commission last month. At that time, they were waiting for clearance from the Bureau of Forestry. This has now been received. The module was signed by the Chairman and will go before the Board of Supervisors.
RICK RETTIG – 2 Lot Subdivision Plan on Street Road. Mr. Rettig is subdividing a lot from his parcel which totals 92 acres. There are presently two dwellings on the property. All fees have been paid and we are waiting to receive the reviews from the Chester County Planning Commission. A Form B – Non Building Waiver will be sent to the Chester County Health Department. Additionally, we have received the NPDES permit for work to be performed. Comments from the Planning Commission are as follows:
Drive on Lot 1 will not be used for access.
Lot 1, which is the second parcel, needs to be 30 acres, (Section 402.A.1.b – Zoning Ordinance)
SHAW/RIDINGS/MEGILL – Final 37 Lot Subdivision Plan on Newark Road. Jim Fritsch presented an email from Penn Dot stating that there is no problem with any site distances. Penn Dot is also in the process of doing HOP plans.
Motion was made by Karl Herr, seconded by Sam Reyburn and carried to approve the Shaw/Ridings/Megill Final Subdivision Plan pending the following items are resolved:
Planning Module approval
Street names approved by County
Street addresses
Chester Water Authority
Penn Dot
Maintenance Documents
Section 502.H – copies of all relevant papers and permits
Storm Water NPDES
MOTION CARRIED – WITH HAROLD BRYSON, OPPOSED
KINGS MILL II – Final 38 Lot Subdivision on Newark Road. We received an adequate letter from Chester County Conservation District. Ron Ragan reviewed Component 4A of the Planning Module with the Planning Commission. The Module was signed by the Chairman and will go before the Board of Supervisors. Some outstanding issues to be resolved are as follows:
DEP approval
Ownership of the sewage plant
Traffic Impact and Community Impact Studies
NPDES Permit
Street addresses
Hydrant placement approval from the fire company and Chester Water Authority

Ron Ragan will schedule a meeting with Castle Valley, Kings Mill II and the Township to discuss concerns and ownership regarding the sewage plant. This will be scheduled before the work session on 9/24th.
FINISH LINE LAND DEVELOPMENT PLAN – Motion was made by Christine Nibouar, seconded by Sam Reyburn to recommend to the Board of Supervisors that they reject the Finish Line Land Development Plan if an extension is not received by the Board of Supervisors, September 10, 2007 meeting. MOTION NOT CARRIED – CHRISTINE NIBOUAR – YEA, SAM REYBURN – YEA, HAROLD BRYSON AND KARL HERR – ABSTAINED.
ZONING AMENDMENTS - Was discussed by the Planning Commission. Definitions of Terms and also Section 901 – Use Regulations were not very clear to the members and they thought the section was very loose. Additionally, the Planning Commission felt that the maximum paved area should not be 75 %. Christine voted – 50% maximum paved area, Sam – 75 %, too much, Harold – 60% maximum paved area and Karl – 55% maximum paved area. Sections 1302, 1405.2, 1409 and 1409.3 are suitable. The Planning Commission would also like to hear the County’s comments. A letter will be sent to the Board of Supervisors with the above concerns.
ADJOURNMENT – There being no further business, motion was made by Harold Bryson, seconded by Karl Herr and carried to adjourn at 9:15 P.M.
