UPPER OXFORD TOWNSHIP APRIL 11, 2005 Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, April 11, 2005 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Edward E. Hook Jane Daggett, Secretary Vivian Miller, Historic Commission Larry Johnson, Historic Commission Yerkes Associates (Andrea Hingley), Zoning John Coldiron, Building Inspector Blair Fleischmann, Emergency Mgmn’t Coordinator Charles Fleischmann, Park Development Committee OTHERS: Frances Sharon Brian Byrd Jay Young Sally Wagner Sam and Frances Reyburn Robert J. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were none at this time. MINUTES -Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the March 16, 2005 Minutes and the March 28, 2005 Work Session Minutes. Gordon - abstained Huber - Yea Hook - Yea BUILDING INSPECTOR -Motion was made by Ed Hook, seconded by Betsy Huber and carried to appoint John D. Coldiron as Building Inspector for Upper Oxford Township retroactive as of April 1, 2005. Gordon -Yea Huber -Yea Hook - Yea ALICE LANE -Jay Young and Brian Byrd, residents of Alice Lane were present to discuss with the Supervisors the problems they are having with water run-off on their properties from the neighboring farms. Mr. Young would like to correct the problem but does not want to do any corrections that would cause more water runoff on the neighboring properties. The Board of Supervisors will have Ragan Engineering review the subdivision plans (McMichael/Irving) to see if the swales that were required at the time of subdivision are still in place. BILL SCHOELL -Requested the Supervisors to implement an Act 537 Plan for the township. Mr. Schoell informed the Supervisors that DEP will pay upto 50% of the cost to activate such a plan and 50% of personnel maintenance costs for annual upkeep. ANTHONY BEILER -Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the Anthony Beiler Sewage Maintenance Agreement for the 5 lot subdivision on Old Limestone Road subject to the Solicitor’s approval. Gordon -Yea Huber -Yea Hook -Yea Upper Oxford Township April 11, 2005 Page 2 MICHAEL PELET -Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the Michael Pelet Sewage Maintenance Agreement for the 11 lot subdivision on University Road. Gordon -Yea Huber -Yea Hook -Yea RICHARD ALTIZER -Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the Richard Altizer Sewage Maintenance Agreement for the 2 lot subdivision on Muddy Run Road subject to the Solicitor’s approval. Gordon -Yea Huber -Yea Hook -Yea JOHN/REUBEN STOLTZFUS -Motion was made by Ed Hook, seconded by Betsy Huber and carried to grant and accept a 90 day extension for Reuben Stoltzfus 2 lot subdivision. Gordon -Yea Huber -Yea Hook -Yea CABLE TV CONTRACTS - Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the Armstrong Cable TV Contract and the Comcast Cable TV Contract subject to the Solicitor’s approval. Gordon -Yea Huber -Yea Hook -Yea ZONING -Andrea Hingley of Yerkes Associates reported that there were no permits for the month of March. ROADS -Tom Guhl was not present. However, his report was reviewed by the Supervisors. Permission was given for Tom to order a new grill for the park at the cost of $607.50. HISTORIC COMMISSION -Larry Johnson reported that the historic commission have been working on a historic ordinance and presented the Supervisors with a first draft for their review. A letter was received from Katherine Steele forfeiting the use of the park for their schoolhouse reunion. The township building will be used for the reunion along with a tent on the township grounds. The tent and table/chairs costs will come out of their fund raising money and will be at no cost to the township. BUILDING INSPECTION -The report done by Todd Savidge, previous inspector, was reviewed by the Supervisors. EMERGENCY MANAGEMENT COORDINATOR -Blair Fleischmann requested that the Supervisors set a budget amount for Emergency Management. PARK DEVELOPMENT -Charles Fleischmann reported to the Supervisors the progress of the Park Development Committee. PAYMENT OF BILLS -Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve the payment of bills in the amount of $35,898.75 from the General Fund. Gordon -Yea Huber -Yea Hook -abstained WEB SITE -Discussion was held regarding having Gail Pietrzky of Oxford design a web site for the township. An estimate of the cost was received from Gail. The Supervisors will view the web sites for New London and Elk Township and then make a decision. (Gail designed New London and Elk Twps. web sites) Upper Oxford Township April 11, 2005 Page 3 SOMERSET CEMETERY -Discussion was held regarding fencing at Somerset Cemetery. This project is being done by Scout Ryan Hook. Ryan will need to seek approval from the Historic Commission on the type of fencing. Additionally, the scouts have dug about 1/3 of the cemetery and found the foundation to the church and two marked stones. EVA GALLAGHER -The Solicitor will send a letter to Mrs. Gallagher regarding her property. Since it is a non-conforming lot, it will need to be sold as one lot and not two lots. CHESTER CO. PLANNING COMMISSION/PENN DOT 12 YEAR PROGRAM -a report was received from the County Planning Commission regarding the scope of work Penn Dot has planned. (2 bridges are in the plan) Ed will review the report and respond to the Chester Co. Planning Commission. RESOLUTION #2005 -6 -Motion was made by Betsy Huber, seconded by Ed Hook and carried to adopt Resolution #2005 –6, supporting the County Wide Mutual Aid Agreement. Gordon -Yea Huber -Yea Hook -Yea Betsy reported that the Supervisors from Londonderry Township would like our road master to check the culverts at the township line and Faggs Manor Road. AG BUILDINGS -were discussed by the Supervisors and the Building Inspector. Ag buildings must be built to code but do not need to be inspected and no fees are required at this time. Charles Fleischmann reported to the Supervisors that Ron Kepler of Lower Oxford Township would like to do some co-operative work regarding the Hartmaier property. HERITAGE BUILDING -Henry suggested to the Supervisors that they not approve the Preliminary Plan of Heritage Building Group until they hire a sewage planner engineer to represent the township regarding the Bartels/Hickman development. Andrea Hingley informed the Board that Yerkes Associates was very experienced with the drip irrigation systems. Motion was made by Betsy Huber, seconded by Ed Hook and carried to hire a sewer expert to oversee the design and construction of any sewage facilities for Heritage Building Development and other future sewage developments.
