UPPER OXFORD TOWNSHIP MAY 9, 2005 Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, May 9, 2005 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Edward E. Hook Jane Daggett, Secretary John Coldiron, Building Inspector Blair Fleischmann, Emergency Mgmn’t Coordinator OTHERS: Henry Huber Christine Nibouar Joe Sexton Scott & Denise Rugen Sam and Frances Reyburn Steve Donnelly Anthony Beiler Charles Fleischmann Nate King Cecil Miller John Samara Steve Folmer Kera Smith After the Salute to the Flag, Betsy Huber led in prayer. At this time, the Board of Supervisors recessed to hold a special hearing which was advertised. The purpose of the hearing was to hear comments regarding the proposed ordinance to establish a tax to maintain fire hydrants. Jim explained which residents would be effective by this tax and the tax would not exceed two (2) mills. There were no comments regarding this from the audience. The hearing was closed at 7:10 P.M. The regular meeting then resumed. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were none at this time. MINUTES - Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the April 11, 2005 Minutes, the April 25, 2005 Work Session Minutes and the May 2, 2005, Special Meeting Minutes. Gordon - Yea Huber - Yea Hook - Yea RICHARD ALTIZER - Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the Richard Altizer 2-Lot Final Subdivision Plan for property located on Muddy Run Road, Project #0443. Gordon - Yea Huber - Yea Hook - Yea Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the Richard Altizer Planning Modules for the 2-Lot Final Subdivision Plan. STOLTZFUS - Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the John S. and Fannie F. Stoltzfus 2-Lot Final Subdivision Plan for property on Edenton Road, Project #0453. (no planning module was required, Form B Non-Building Waiver will be sent) Gordon - Yea Huber - Yea Hook - Yea ANTHONY BEILER - Motion was made by Betsy Huber, seconded by Ed Hook and carried to grant and accept a 300 day (10 month) extension for Anthony Beiler for the purpose of receiving DEP approval on his 5-Lot Subdivision Plan. Additional testing has been required on the soils. Gordon - Yea Huber - Yea Hook - Yea J. MICHAEL PELET - Motion was made by Betsy Huber, seconded by Ed Hook and carried to grant and accept a 90-day extension for the J. Michael Pelet 11-lot subdivision on University Road. Gordon - Yea Huber - Yea Hook - Yea HERITAGE BUILDING GROUP - Motion was made by Betsy Huber, seconded by Ed Hook and carried to grant and accept a 30-day extension from Heritage Building Group for the 81-lot subdivision plan on the Bartels/Hickman property. Gordon - Yea Huber - Yea Hook - Yea COMMUNITY OF LOVE LUTHERAN CHURCH - Motion was made by Betsy Huber, seconded by Ed Hook and carried to grant and accept a 180-day extension for the Community of Love Lutheran Church Land Development Plan along Route 896 and Penns Grove Road. Gordon - Yea Huber - Yea Hook - Yea ROAD MATERIAL CONTRACTS - Sealed bids were received and opened May 2, 2005. The results of the bids are as follows: Motion was made by Ed Hook, seconded by Betsy Huber and carried to award the following: D. M. Stoltzfus & Son Stone McMinn’s Asphalt Co., Inc. Road Oil and Black Top McMinn’s Asphalt Co., Inc. Seal Coat - In Place Alger Oil Diesel Fuel/Heating Oil Gordon - Yea Huber - Yea Hook - Yea ZONING - There was no report from the Zoning Officer this month. BUILDING INSPECTOR - John Coldiron read his report for the month. John informed the Supervisors that he had one concern regarding a garage/agricultural building on the Folmar property which has 10 acres. Mr. Folmar was informed that he did not need to pay a building permit fee since his storage building is agricultural. Mr. Folmar is using the building for a garage and also to store horses and horse related equipment. After discussion, Motion was made by Ed Hook, seconded by Betsy Huber and carried to keep the permit fee for Mr. Folmar at $250.00 for the detached garage/building and eliminate the additional square footage fee. Gordon - Yea Huber - Yea Hook - Yea Upper Oxford Township May 9, 2005 Page 3 EMERGENCY MANAGEMENT COORDINATOR - Blair read her report for the month and updated the Supervisors on her activities. Additionally, Jim announced that the County is holding a training event on Saturday, May 14, 2005 which is opened to the public at “no charge”. PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the payment of bills in the amount of $24,250.26 from the General Fund and $77,000.00 from the State Fund to purchase a Certificate of Deposit. Gordon - Yea Huber - Yea Hook - Yea ROAD CONSTRUCTION - Motion was made by Jim Gordon, seconded by Ed Hook and carried to adopt Resolution #2005 - 7, using approximately $57,386.63 Liquid Fuels for road construction on Forest Manor Road, University Road and Cheek Road. Gordon - Yea Huber - Yea Hook - Yea ZONING AMENDMENTS - Motion was made by Jim Gordon, seconded by Ed Hook and carried to instruct the Solicitor to advertise for a hearing to change Section 403 in the R-1 District and Section 502 in the R-2 District. Section 403.A3.ii, to read as follows: “Permitted residential lots with on lot water and public or community sewer” Section 502.B, to read as follows: “All permitted residential uses served with individual water services and community or public sewers” Gordon - Yea Huber - Yea Hook - Yea ZONING CHANGES/AG ZONING - Motion was made by Betsy Huber, seconded by Ed Hook and carried to accept a proposal from Chester County Planning Commission for planning services to township’s zoning ordinance update and agricultural zoning district and to accept the Chester County Vision grant proposal which will provide 75% reimbursement from the County. Gordon - Yea Huber - Yea Hook - Yea STATE GRANT MONEY - Motion was made by Ed Hook, seconded by Betsy Huber and carried to appoint James E. Gordon to execute any agreement with the State regarding the grant money to be applied towards the development of the new park. Gordon - Yea Huber - Yea Hook - Yea FEE SCHEDULE - Motion was made by Betsy Huber, seconded by Ed Hook and carried to adopt Resolution No. 2005-8, which is the new fee schedule for building permits. Gordon - Yea Huber - Yea Hook - Yea WEB SITE - was discussed again. Jim will contact Gail Pietrzky of Oxford to meet with him and the secretary. Upper Oxford Township May 9, 2005 Page 4 SEWAGE CONSULTANT - was discussed by the Supervisors. Motion was made by Ed Hook, seconded by Betsy Huber and carried to hire Yerkes Associates, Inc. as sewage consultants to work with and represent the township on the Bartels/Hickman subdivision plan. Gordon - Yea Huber - Yea Hook - Yea ZONING - The Secretary will contact the zoning officer to find out the status of the house that needs to be taken down located on Baltimore Pike. CEMETERY - Supervisors decided to have the road crew place a stone driveway at the Somerset Cemetery. HISTORIC ORDINANCE - The Supervisors will meet with the Historic Commission on May 24, 2005 at 7:00 P.M. to review the historic ordinance. The Supervisors and the Planning Commission will hold a special meeting on May 16, 2005 at 7:00 P.M. to discuss zoning.
