Upper Oxford Township Board of Supervisors held an advertised hearing at the township building, 1185 Limestone Road, Russellville, PA on Monday, July 11, 2005 at 6:45 P.M.

After the Salute to the Flag, Jim Gordon led in prayer.
At this time, the hearing was opened to the public. The hearing was duly advertised in the Daily Local News. Proof of publication was on hand. The purpose of the hearing was to hear comments regarding amended sections in the zoning ordinance. The amended sections are Section 403.A.3.a.ii and Section 502.B. There were no comments from the audience.
The hearing was closed at 6:55 P.M.
At 7:00 P.M., the regular monthly meeting of the Board of Supervisors commenced.
PUBLIC COMMENTS -At this time, public comments were asked for from the audience based on the agenda. There were no comments at this time.
MINUTES -Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the June 13, 2005 Minutes.

MICHAEL PELET -11 Lot Subdivision on University Road presented by Ed Jefferis. After discussion, the Board of Supervisors decided that the “open space” shall be included as part of Lot 11 and that the lot cannot be further subdivided. Mr. Jefferis will consult with the township solicitor regarding this open space. Additionally, Lot 11 will also be considered for “fire pond” use. The road name “Lewis Drive” was also discussed. Mr. Jefferis will contact the townships 911 coordinator for suggested road names.
BARTELS/HICKMAN -81 lot subdivision plan on Route 896.
Residents, Kera Smith and Steve Donnelley presented a slide show and presentation comparing this subdivision plan and drip irrigation system to the systems used in the Bridlewood Farm development in Thornbury Township and Ridglea development in South Coventry Township. Mrs. Smith and Mr. Donnelley also voiced their concerns regarding what they felt was incomplete and not adequate for this development’s system.
At this time, Andrew Rau and Nina Seidel and Anthony Meeris of the Heritage Building Group came forward to seek Preliminary Approval for their 81 lot subdivision at the Bartels/Hickman tract.
While Mr. Rau conceded that there is still much work to be done on the Planning Modules and other outstanding items which reference Ron Ragan’s letter of June 1, 2005, Heritage would like Preliminary Approval with contingencies.
Winnie Sebastian, solicitor for the township was present and discussed receiving the threat of removing the offer of funding for the improvement of Route 896 and 131 intersection, from the applicant if the Supervisors did not grant approval. Winnie also stated the outstanding items that still needed to be resolved before any approval can be granted.
The Board of Supervisors held an executive session to discuss all prospects of this subdivision.
Motion was made by Ed Hook, seconded by Betsy Huber and carried to reject the Preliminary Plan of Heritage Building Group based on the following sections of the Subdivision and Land Development Ordinance:
Section 406.C, Section 501.0, Section 503, Section 614.A, Section 613.C.l.a, Section 622.B, Section 631.C.l.a (SEE ATTACHMENT)

ZONING AMENDMENTS -Motion was made by Betsy Huber, seconded by Ed Hook and carried to adopt Ordinance No. 1 -2005. The following sections shall be amended and changed as follows:
SECTION 403.A.3.a.ii –
“permitted residential lots with on lot water and public or community sewer”
SECTION 502.B –
“all permitted residential uses served with individual water services and community or public sewer”

AG SECURITY ADDITIONS -More than 180 days have passed since Douglas J. Randolph has submitted a proposal to add 57.2 acres to the present Ag Security District and Robert L. Holmes submitted a proposal to add 184 acres to the present Ag Security District. Since no action was taken, the additions are automatically approved.
Motion was made by Betsy Huber, seconded by Ed Hook and carried to adopt Resolution No. 2005 -9, authorizing the Secretary to file a description of this addition with the Recorder of Deeds.

ZONING -There was no report given this month.
ROADS -Tom Guhl read his report for the month and also included his findings on the road study done on Cullen Road.
BUILDING INSPECTOR - John Coldiron read his report for the month.
EMERGENCY MANAGEMENT COORDINATOR -Charles Fleischmann presented Blair Fleischmann’s report for the month.
PARK DEVELOPMENT -Charles Fleischmann read the report from the Park Development Committee.
HISTORIC COMMISSION -Motion was made by Jim Gordon, seconded by Betsy Huber and carried to appoint Hazel Gray Duncan to serve on the Historic Commission.

PAYMENT OF BILLS -Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the payment of bills in the amount of $28,319.35 from the General Fund, $3,617.51 from the State Fund and $211.57 from the Open Space Fund.

ADJOURNMENT -There being no further business, motion was made by Ed Hook, seconded by Betsy Huber and carried unanimously to adjourn at 8:25 P.M.
