UPPER OXFORD TOWNSHIP SEPTEMBER 12, 2005 Upper Oxford Township Board of Supervisors held an advertised hearing at the township building, 1185 Limestone Road, Russellville, PA on Monday, September 12, 2005 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Edward E. Hook Jane Daggett, Secretary Tom Guhl, Road Master John Coldiron, Building Inspector Joe Sexton and Charles Fleischmann, Park Dev. Committee OTHERS: Nathan King Henry Huber Tom Zadnik Steve Donnelley Denise and Scott Rugen Christine Nibouar William and Kera Smith John and Peggy Platt John Samara Gary Calibey Gale Miller Bill Schoell Linda and Dennis Peterson After the Salute to the Flag, Ed Hook led in prayer. At this time, the hearing was opened to the public. The hearing was duly advertised in the Daily Local News. Proof of publication was on hand. Notices were sent on August 11, 2005 to Mr. and Mrs. David Fisher, owners of the property which will be effective by this change. The property was posted on September 2, 2005 by the road crew. Notice of the proposes amendment and map change was forwarded to the Chester County Planning Commission on August 8, 2005. The purpose of the hearing was to receive comments and discussions regarding amending the L-I district along Route 10 to include Tax Parcel #57-4-16.4 consisting of 45.5 acres and also amend definitions and regulations of composting. No questions or comments were offered by the public. The hearing was closed at 7:10 P.M. At 7:11 P.M. the regular monthly meeting of the Board of Supervisors commenced. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were no comments at this time. MINUTES - Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the August 8, 2005 Minutes. Gordon - Yea Huber - Yea Hook - Yea CONSTANCE BIDDLE SUBDIVISION - Due to the death of Mrs. Biddle, her estate is in the process of selling the remaining lots. Motion was made by Jim Gordon, seconded by Ed Hook and carried to agree to release the financial security on the Constance Biddle property as long as substitute financial security to the satisfaction of the township solicitor and in an amount determined by the township engineer is fully in place to guarantee the construction of the improvements. Gordon - Yea Huber - Yea Hook - Yea Upper Oxford Township September 12, 2005 Page 2 FORESTVILLE BUSINESS CENTER, LOT 3 - Motion was made by Betsy Huber, seconded by Ed Hook and carried to accept and grant a 90 day extension for the Forestville Business Center, Lot 3, in order to obtain documentation of the NPDES permits. Gordon - Yea Huber - Yea Hook - Yea BARTELS/HICKMAN - 81 lot subdivision plan on Route 896 - Motion was made by Betsy Huber, seconded by Ed Hook and carried to accept and grant an extension from the Heritage Building Group until October 10, 2005 Board of Supervisors meeting. Gordon - Yea Huber - Yea Hook - Yea LINDA PETERSON/ALBERT TALLEY - 3 lot subdivision on Spring Valley Road - Motion was made by Ed Hook, seconded by Betsy Huber and carried to approve the 3 lot subdivision for Linda Peterson/Albert Talley, Project No. 0511. (Form B waiver was required) Gordon - Yea Huber - Yea Hook - Yea AGRICULTURAL SECURITY AREA - A petition was received from Ernest Hoffman to add Tax Parcel #57-03-37, which is 41.9 acres to the present Agricultural Security Area. No action was taken at this time. ORDINANCE NO. 2 - 2005 - Motion was made by Jim Gordon, seconded by Ed Hook and carried to adopt Ordinance No. 2 - 2005 amending the L-I District along Route 10 at the border of Upper Oxford Township and West Fallowfield Township to include Tax Parcel #57-4-16.4 consisting of 45.5 acres and also amending the definition and regulations of composting. Gordon - Yea Huber - Yea Hook - Yea BUILDING INSPECTOR - John Coldiron read his report for the month. ROADS - Tom Guhl read his report for the month. Jim Gordon commended the road crew along with Lower Oxford’s road crew on their paving projects last month. EMERGENCY MANAGEMENT - Blair Fleischmann submitted her report for the month. PARK - There was no park report this month. ZONING - No report PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Ed Hook and carried to approve the payment of bills in the amount of $29,223.52 from the State Fund, the amount of $327.58 from the Open Space Fund and the amount of $36,952.06 from the General Fund. Gordon - Yea Huber - Yea Hook - Yea FEMA FLOOD MAPS - Permission was given to the Secretary to forward the new FEMA Flood Maps to the township engineer for review and comments. CHALLENGE GRANT APPLICATION - The County has recommended to the Township that Luther and Gertrude Reyburn be considered as applicants for the Challenge Grant Program. Betsy recommended that the Solicitor proceed and advertise for a hearing. The Township will certify that total funds available will be $170,000.00 for Challenge Grant Program, Round 2005 and will file a certification with the County. Upper Oxford Township September 12, 2005 Page 3 ACT 537 - Resident, Bill Schoell questioned if Supervisors had any consideration of the Act 537 Plan. Betsy informed the audience that David Ward of Chester County Planning Commission advised the Township not to adopt their own Act 537 but to abide by the County’s Act 537 in order to have more control. PARK DEVELOPMENT - John Samara questioned whether or not a hearing would be necessary to adopt or approve the new park development plan. Jim informed the audience that the plans were still in the hands of the engineer and were not final yet.
