UPPER OXFORD TOWNSHIP JANUARY 3, 2006 Upper Oxford Township Board of Supervisors held their organization meeting at the Township Building, 1185 Limestone Road, Russellville, PA on Tuesday, January 3, 2006 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann Jane Daggett, Secretary Thomas W. After the Salute to the Flag, Jim Gordon led in prayer. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were no comments. TEMPORARY CHAIRMAN - Motion made by Jim Gordon, seconded by Charles Fleischmann and carried to appoint Betsy E. Huber as Temporary Chairman. Secretary-Treasurer Jane Daggett at $14.50/hr. recommending to Auditors that the Treasurer’s Bond be set at $500,000.00. Roadmaster: Thomas W. Guhl at $17.20/hr. Alternate Engineer: Concord Land Planners Bank for Official Business: People’s Bank with investments being made at People’s Bank, Fulton, Wachovia or Coatesville Savings Zoning Officer: John Coldiron Building Inspector: John Coldiron at $10,000.00/yr. Planning Commission Member: Christine Nibouar for a 5 year term Vacancy Board Chairman: Joe Sexton for a 1 year term Planning Commission Secretary Jane L. Daggett Zoning Hearing Board Member Scott Rugen for a 3 year term Historic Commission Member (to be appointed later) Snow Equipment Operators: Jerry Roland, Joe Sexton, Chris Phillippe, Arnold Davis and Gerald Rohrer at $12.00/hr. Legal Notices may be placed in the Oxford Tribune, Chester County Press or Daily Local News. Investments - The Chairman and Secretary are authorized to keep idle funds invested. Other Road Wages: Part-time Equipment Operators - $12.00/hr and Laborers - $12.00/hr. Upper Oxford Township January 3, 2006 Page 3 Working Supervisors: All three Supervisors are affirmed to work on roads if needed; request Auditors’ approval of $12.00/hr for other road work and $12.00/hr. for snow equipment operations. Recommend to Auditors that Supervisors be reimbursed $.44.5/mile to attend Road Inspections, Conventions and Seminars. Road Crew Benefits: 7 paid holidays 2 paid sick days - not to be carried over Paid Vacation: after 1 year 5 days after 2 years 7-1/2 days after 3 years 10 days after 4 years 12-1/2 days after 5 years 15 days Gordon - Yea Huber - Yea Fleischmann - Yea DELEGATE TO STATE CONVENTION - Motion made by Jim Gordon, seconded by Charles Fleischmann and carried designating Betsy Huber as the Township’s Voting Delegate to the State Convention to be held in Hershey, PA., April 23 - 26, 2006, and authorizing payment of registration fees. Charles Fleischmann will be the alternate voting delegate. Gordon - Yea Huber - Yea Fleischmann - Yea RADIO FREQUENCIES - Motion made by Jim Gordon, seconded by Betsy Huber and carried permitting Union Fire Co. #1, Oxford Borough, East Nottingham Township and West Grove Borough to use SWCCT radio frequency (151.0700) for a period of one year. Gordon - Yea Huber - Yea Fleischmann - Yea RESPONSE TERRITORIES - Motion made by Betsy Huber, seconded by Charles Fleischmann and carried adopting Resolution No. 2006 - 1 designating emergency response areas in the township. Gordon - Yea Huber - Yea Fleischmann - Yea MINUTES - Motion made by Betsy Huber, seconded by Charles Fleischmann and carried approving the December 12, 2005 Minutes. Gordon - Yea Huber - Yea Fleischmann - Yea BUILDING INSPECTION - John Coldiron read his report for the month. ROADS - Tom Guhl read his report for the month. The speed study performed on Pusey Mill Road was discussed by the Supervisors and the Road Master. Tom mentioned that their recommendations seemed straight forward. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried that the Solicitor be instructed to proceed with the steps to write an ordinance based on the road study performed on Pusey Mill Road. Gordon - Yea Huber - Yea Fleischmann - Yea 2006 FIRE PROTECTION CONTRACT WITH COCHRANVILLE FIRE COMPANY Motion made by Betsy Huber, seconded by Charles Fleischmann and carried to approve and sign the 2006 Fire Protection Contract. Gordon - Yea Huber - Yea Fleischmann - Yea GARY CALIBEY ESCROW RELEASE - Motion made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the Gary Calibey Escrow Release in the amount of $3,000.00 based upon recommendation of the township engineer, Ragan Engineering, Inc. Gordon - Yea Huber - Yea Fleischmann - Yea GARY CALIBEY ROAD AND IMPROVEMENT CONSTRUCTION AGREEMENT - Motion made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the Gary Calibey Road and Improvement Construction Agreement based upon recommendation of the township solicitor. Gordon - Yea Huber - Yea Fleischmann - Yea BRENDAN DOUGHERTY - 2 LOT SUBDIVISION ON KIMBLE ROAD - This will be processed by Lower Oxford since most of the subdivision is in their township. Motion was made by Betsy Huber, seconded by Jim Gordon and carried to waive the subdivision review process on Project No. 0534 since this property is mostly in Lower Oxford Township including the proposed and existing building and this motion is not considered to be a precedent. Gordon - Yea Huber - Yea Fleischmann - Yea MICHAEL PELET, n/k/a GEORGE KIRIAKIDI - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to accept and grant an extension until May 1, 2006 for review of the Final Subdivision Plan. Gordon - Yea Huber - Yea Fleischmann - Yea S.P.C.A. CONTRACT - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the 2006 S.P.C.A. Stray Boarding Contract. Gordon - Yea Huber - Yea Fleischmann - Yea SCOTT DOWNS - is purchasing William Moore’s property on Baltimore Pike. Mr. Downs discussed with the Supervisors the removal of the old house on the property in order to receive a Use and Occupancy Permit. Mr. Downs was instructed to contact the Building Inspector. Upper Oxford Township January 3, 2006 Page 5 ROBERT YODER - Stated exception over the Secretary’s previous minutes, Page 2, regarding his questions to Supervisors Wanted to know if Supervisors are taking action on his recommendation of Code of Ethic His expectations for a “resident friendly township” and wanting evening office hours “Resident friendly expectation - photo copies are a rip-off Audio/PA system - Mr. Yoder will sit closer Wanted Jim to repeat his opinion from last month. Feels charging $ .50 for copies is a direct retaliation against residents asking for information Supervisor Gordon stated that the ethic resolution presented by Mr. Yoder would be in disrespect to the people employed by Upper Oxford and also to the citizens who volunteer their time to serve the township. Supervisor Fleischmann stated that the township follows the Pennsylvania Municipal Code Book and abides by it, which has a higher ethical standard than Mr. Yoder’s resolution. Supervisor Fleischmann also told Mr. Yoder to raise his hand if he cannot hear him and he will speak louder. PARK REPORT - Blair asked if there could be a report from the Park Committee and Historic Committee next month.
