UPPER OXFORD TOWNSHIP MARCH 13, 2006 Upper Oxford Township Board of Supervisors held their regular scheduled meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, March 13, 2006 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann Jane Daggett, Secretary Tom Guhl, Road Master John Coldiron, Building Inspector and Zoning Officer OTHERS: Anthony Beiler Scott Rugen Christine Nibouar Frances & Sam Reyburn Joe Sexton Kera Smith After the Salute to the Flag, Jim Gordon led in prayer. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were no comments from the audience. MINUTES - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the February 13, 2006 Minutes. Gordon - Yea Huber - Yea Fleischmann - Yea MICHAEL PELET, k/n/a GEORGE KIRIAKIDI - 11 Lot Final Subdivision Plan on University Road. Recommendations were received from the Planning Commission to waive ordinance requirements on the size of pipe to be used. Since Ed Jefferis, representing the applicant was not available, action will be taken at next month’s meeting. KINGS MILL I - 32 Lot Preliminary Subdivision Plan on Newark Road. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to accept and grant a 100 day extension for the Kings Mill I Subdivision which would expire July 12, 2006. Gordon - Yea Huber - Yea Fleischmann - Yea WIGGINS/MEGILL HOMES - “Bainbridge” subdivision for 16 Lot Preliminary Plan on Pusey Mill Road. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to accept and grant a 90 day extension for the Wiggins/Megill Homes Subdivision. Gordon - Yea Huber - Yea Fleischmann - Yea KISMET FARM/ANTHONY BEILER - 5 Lot Final Subdivision on Limestone Road. This plan was approved by the Board of Supervisors and sent to DEP, however, DEP did not approve the plans due to nitrate levels. Mr. Beiler is trying to find an alternate system due to high water nitrate levels and therefore is requesting an extension. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to accept and grant a 10 month extension for the Kismet/Beiler Farm Subdivision Plan. This extension will expire January 13, 2007. Gordon - Yea Huber - Yea Fleischmann - Yea Upper Oxford Township March 13, 2006 Page 2 PLANNING COMMISSION - Recommending and requesting that the Board of Supervisors retain a sewage consultant firm for all subdivisions that are planning drip systems and also that the township engineer attend the Planning Commission meetings. Permission given for Christine Nibouar to contact Castle Valley Engineers and invite them to attend a work session on March 27, 2006 at 7:00 P.M. Permission given for the township engineer to attend the Planning Commission meetings as needed, and to be contacted by the Secretary or Chairman of the Planning Commission. The engineer’s time will be billed to the applicant. BUILDING INSPECTION - John Coldiron read his report for the month. ZONING - John also gave his zoning report for the month. ROADS - Tom Guhl read his report for the month. Tom also reported that the roadway on Baltimore Pike was measured and found to have a 7% grade. According to Penn Dot specifications, the percentage of grade must be 4% or less to qualify for “Brake Retarder Prohibition” signs. Therefore, Penn Dot will not consider our request for signs in that area. Road Contract Bids - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to authorize the Secretary to advertise to accept road materials bids, which will be opened at a special meeting on May 1, 2006 and awarded May 8, 2006. Gordon - Yea Huber - Yea Fleischmann - Yea EMERGENCY MANAGEMENT - A report was received from the Emergency Management Coordinator. PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the payment of bills in the amount of $46,917.96 from the General Fund and the amount of #346.69 from the Open Space Fund. Gordon - Yea Huber - Yea Fleischmann - Yea AG SECURITY DISTRICT - More than 180 days have passed since Ernest Hoffmann has submitted a proposal to add 41.9 acres to the present Ag Security District. Since no action was taken, the addition is automatically approved. Motion was made by Jim Gordon, seconded by Betsy Huber and carried to adopt Resolution No. 2006 - 3, authorizing the Secretary to file a description of the addition with the Recorder of Deeds Office. Gordon - Yea Huber - Yea Fleischmann - Yea FIRE HYDRANT TAX - The Supervisors enacted an ordinance to establish a fire hydrant tax for property owners within 780 feet of the fire hydrant. Motion was made by Betsy Huber, seconded by Jim Gordon and carried to set the millage rate for those properties affective by it at .00019 mills. Gordon - Yea Huber - Yea Fleischmann - Yea HISTORIC ORDINANCE - Larry Johnson is working on revising the previous ordinance given to the Supervisors. Upper Oxford Township March 13, 2006 Page 3 STORM WATER MANAGEMENT ORDINANCE - Charlie explained Act 167 affecting all municipalities in the county. He will present a model Storm Water Management Ordinance to the Planning Commission for review at their next meeting. ROUTE 896 TASK FORCE - is finalizing its documents. All material will go to each municipality and Chester County Planning Commission to receive reviews.
