UPPER OXFORD TOWNSHIP APRIL 10, 2006 Upper Oxford Township Board of Supervisors held their regular scheduled meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, April 10, 2006 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann Jane Daggett, Secretary Tom Guhl, Road Master John Coldiron, Building Inspector/Zoning Officer OTHERS: Ed Jefferis Christine Nibouar Harold Bryson Scott Rugen Sam Reyburn Joe Sexton Fran and Frannie Sharon Ed Hook Steve Donnelley Joseph and Louise Cappelli Kera Smith Frances Reyburn Chris Coburn Beth Sears After the Salute to the Flag, Betsy Huber led in prayer. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were no comments from the audience. MINUTES - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the February 22, 2006 Hearing minutes, the February 22, 2006 Special Meeting minutes and the March 13, 2006 minutes. Gordon - Yea Huber - Yea Fleischmann - Yea KARL HERR - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to grant and accept a 90 day extension for the Karl Herr 2 Lot Subdivision. Gordon - Yea Huber - Yea Fleischmann - Yea WILLIAM AND MARGARET SHAW - 37 Lot Subdivision on Newark Road. Motion was made by Betsy Huber, seconded by Jim Gordon and carried instructing the Secretary to send a letter to Lower Oxford Township and Penn Township requesting them to waive their review process for the William and Margaret Shaw subdivision. Gordon - Yea Huber - Yea Fleischmann - Yea MICHAEL PELET - 11 Lot Final Subdivision on University Road. Ed Jefferis of Concord Land Planners was present to request the Board of Supervisors to waive the requirements regarding the size of pipe used in this subdivision. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried granting the request that storm water pipes shall have at least a minimum inside diameter of fifteen (15) inches, except that pipes under twenty-four inches or greater fill shall not be less than twenty-four (24) inches in diameter and as long as the minimum ground cover over the crown of the pipe is at least eighteen (18) inches and not more than nine (9) feet. Gordon - Yea Huber - Yea Fleischmann - Yea Upper Oxford Township April 10, 2006 Page 2 CASTLE VALLEY CONSULTANTS - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to appoint Castle Valley Consultants as consultants for the township to review all sewage modules. Gordon - Yea Huber - Abstained Fleischmann - Yea ROADS - Tom Guhl read his report for the month. BUILDING AND ZONING - John Coldiron read his building and zoning reports for the month. EMERGENCY MANAGEMENT COORDINATOR - Blair Fleischmann was not present but sent her report. PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the payment of bills in the amount of $404.51 from the Open Space Fund and $47,894.16 from the General Fund. Gordon - Yea Huber - Yea Fleischmann - Yea AG SECURITY ADDITIONS - More than 180 days have passed since Mathew Faulkner, Sr. has submitted a proposal to add 1.1 acre to the present Ag Security District and Harold and Janet Robinson have submitted a proposal to add 3,850 square feet to the present Ag Security District. Since no action was taken, the additions are automatically approved. Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to adopt Resolution #2006 - 4 authorizing the Secretary to file a description of the additions with the Recorder of Deeds Office. CHESTER CO. S.P.C.A. - A letter was received from the S.P.C.A. inquiring who is responsible for animal control. Since the township has a Stray Boarding Limited Contract with the S.P.C.A., no response is necessary. FIRE HYDRANT - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to instruct the Solicitor to advertise for a hearing to enact a tax to maintain fire hydrants in the township. Gordon - Yea Huber - Yea Fleischmann - Yea CAPPELLI HEARING - A hearing has been scheduled May 18, 2006, whereas Joseph and Louise Cappelli are challenging the enactment of Ordinance #2006 - 2. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to instruct the Solicitor to uphold the township ordinance and that it was properly adopted. Gordon - Yea Huber - Yea Fleischmann - Yea RECYCLING - The Township received $2,422.00 for their recycling efforts in 2004. CABLE TV ORDINANCE - The cable contracts with Comcast Cable and Armstrong Cable were discussed. It was noted that Comcast wants to reduce the density of homes per mile in their contract, however, Armstrong has 15 houses per mile. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to adopt the cable contract with Armstrong Cable Co. for the cable TV franchise. Gordon - Yea Huber - Yea Fleischmann - Yea ROAD BIDS - The road bids will be opened at a special meeting held May 1, 2006 at 7:00 P.M. Upper Oxford Township April 10, 2006 Page 3 BETH SEARS - of 100 Wilson Drive informed the Supervisors of a animal rights group called “SHAC” and requested the Supervisors enact a permit for protesters groups in the township. Betsy will pursue PSATS for sample ordinances. HISTORIC COMMISSION - Charlie informed the Board that the Municipal Code calls for the Historic Commission to be a part of the review and approval process for all subdivision plans. ED HOOK - questioned the Supervisors if the township was still a dry township and if the township provides for adult bookstores in our ordinances. Betsy will check into our ordinance to see what is allowed. ADJOURNMENT - There being no further business, Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried unanimously to adjourn at 8:30 P.M.
