UPPER OXFORD TOWNSHIP MAY 8, 2006 Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, May 8, 2006 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann Jane Daggett, Secretary John Coldiron, Building Inspector/Zoning Officer OTHERS: Ed Hook Steve Donnelley Eugene Racine B. McCaffe Sam Reyburn Frances Reyburn Kera Smith Gary Calibey Joseph Cappelli Beth Sears Andrew Rau Gia Faffaelli Nina Seidel Franny Sharon After the Salute to the Flag, Jim Gordon led in prayer. At this time, a public hearing was called to order. Proof of publication was on hand. The purpose of the hearing was to give information and also receive comments from the public regarding the enactment of a tax for establishing and maintaining fire hydrants. Presently the township has 7 hydrants. Five are in Turners Pond development, one located on Baltimore Pike and one located on Forestville Road, which is solely paid for by Crown Hardwood. Property owners within 780 feet of the hydrants will be taxed. The millage will be at .000195 (not quite 2/10th of a mill). Example: based on assessed value of $500,000, the assessed value would be $29.50/year. There were no comments from the audience. The hearing adjourned at 7:10 P.M. At this time, the regular meeting was held. PUBLIC COMMENTS - At this time, public comments were asked for from the audience based on the agenda. There were none at this time. MINUTES - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the April 10, 2006 minutes. Gordon - Yea Huber - Yea Fleischmann - Yea HICKMAN/HERITAGE BUILDING GROUP - 2 Lot Subdivision on Baltimore Pike. Andrew Rau discussed with the Supervisors approval of this minor 2 lot subdivision plan. Our Planning Commission approved this plan on May 1, 2006 with contingencies. Areas of discussion were: not having the non building waiver from Chester County Health Department, Hickmans will need to join in the signing of this plan and also the Bartels/Hickman 81-Lot subdivision plan, open space calculations to be performed at the time of the Land Development Plan, temporary construction easement was explained to the Board and open space. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the Hickman/Heritage Building Group, 2-Lot Minor Subdivision Plan with the following contingencies: · Plans will need signatures and notarization · Elimination of Note 6 in the general notes · Waiver of Section 501 K.6 “existing trees with a caliper of six (6) inches or greater” was granted and should be shown on plan Form B Non Building Waiver received from Chester County Health Department Upper Oxford Township May 8, 2006 Page 2 Gordon - Yea Huber - Yea Fleischmann - Yea KARL HERR - 2 Lot Subdivision and Add-on Plan on Old Limestone Road. PLANNING MODULE - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to adopt Resolution #4-2006 which is the Karl and Barbara Herr, Planning Module for a 2 lot subdivision and add-on. Gordon - Yea Huber - Yea Fleischmann - Yea AGREEMENT - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve the Installation and Maintenance Agreement For An On-Lot Wastewater Disposal System for Karl and Barbara Herr. Gordon - Yea Huber - Yea Fleischmann - Yea SUBDIVISION - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the Karl and Barbara Herr 2-Lot Final Subdivision and Add-on Plan, Project No. 0598. Gordon - Yea Huber - Yea Fleischmann - Yea PENNS GROVE ASSOCIATES/HARTMAIER - 11 Lot Preliminary Subdivision on Pennsgrove Road. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to grant and accept a 90 day extension for the Penns Grove Associates. (This extension will expire September 2, 2006.) Gordon - Yea Huber - Yea Fleischmann - Yea MALLET HILL ESTATES/ALFRED FORTUGNO - 77 Lot Preliminary Subdivision Plan on Ewing and Forest Manor Road. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to grant and accept a 100 day extension for the Mallet Hill Estates Subdivision. (This extension will expire September 11, 2006) Gordon - Yea Huber - Yea Fleischmann - Yea KINGS MILL II - 38 Lot Preliminary Subdivision Plan on Newark Road. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to grant and accept a 100 day extension for the Kings Mill II Subdivision. (This extension will expire September 11, 2006). Gordon - Yea Huber - Yea Fleischmann - Yea FORESTVILLE BUSINESS CENTER - LOT 3 - Our zoning officer and building inspector, John Coldiron explained to the Board that the owners would like to change the front of the building to be located facing the by-pass. Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve this change contingent upon the owner providing “as built” plans approved by the Solicitor. Gordon - Yea Huber - Yea Fleischmann - Yea ROADS - Tom Guhl submitted his report for the month. BUILDING INSPECTOR - John Coldiron read his report for the month. ZONING - John Coldiron read his report for the month. Upper Oxford Township May 8, 2006 Page 3 EMERGENCY MANAGEMENT - Blair Fleischmann submitted her report for the month. PAYMENT OF BILLS - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to approve the payment of bills in the amount of $23,578.57 from the General Fund and the amount of $580.74 from the Open Space Fund. Gordon - Yea Huber - Abstained Fleischmann - Yea ROAD CONTRACT BIDS - Sealed bids were received and opened May 1, 2006. Black Top Asphalt Industries Seal Coat - In Place Alger Oil Heating Oil and Diesel Fuel Gordon - Yea Huber - Yea Fleischmann - Yea ORDINANCE NO. 2006 - 3 - FIRE HYDRANT ORDINANCE Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt Ordinance No. 2006 - 3, Establishing A Tax Not To Exceed 2 Mills Specifically For The Purpose Of Establishing And Maintaining Fire Hydrants And Fire Hydrant Water Service For Those Area Established Upon All Property Within 780 Feet Of Any Fire Hydrant Located Within The Township. Gordon - Yea Huber - Yea Fleischmann - Yea FIRE HYDRANT TAX - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to set the millage at .000195 for properties within 780 feet of fire hydrants. (this is .195 mills) Gordon - Yea Huber - Yea Fleischmann - Yea ELLEN RANCK AND LUTHER AND GERTRUDE REYBURN - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to sign and adopt the amended agreement for the Ellen Ranck property and the Luther and Gertrude Reyburn property. Gordon - Yea Huber - Yea Fleischmann - Yea BIRD HOUSES - Permission was given to Nancy Miller and Cub Scout Pack 272 to build and erect 3 blue bird house in the township park as part of their badge projects. SILVESTRI CLEANING SERVICES/COVERALL CLEANING CONCEPTS - Requesting Supervisors to sign a one year contract since they are being bought by Coverall Cleaning Concepts. Accepted by Supervisors. PARK CLEAN UP - Charlie presented the costs of having a dumpster placed at the township park to eliminate the need for Tom and Jim Wilson to come in on the weekends to clean the park. Monterey Trash would place a dumpster at the park at the cost of $72.00/month and pick-up once a week. Supervisors discussed and did not approve. Upper Oxford Township May 8, 2006 Page 4 ROUTE 896 TASK FORCE - Charlie explained the Planning Commission should take their recommendation to the Route 896 Task Force before the next meeting to be held May 22, 2006. PERMITS - Betsy informed the audience and board that she was still trying to get sample ordinances for demonstrating groups to have permits. She will contact the state association. FRANCES REYBURN - Requested that the Historic Committee be placed on the agenda for each meeting. She also informed the Supervisors that the group is gathering data regarding the Fortugno property and that Jane Davidson will be here at the next supervisors meeting. ADJOURNMENT - There being no further business, motion was made by Charles Fleischmann, seconded by Betsy Huber and carried unanimously to adjourn at 8:35 P.M.
