UPPER OXFORD TOWNSHIP JUNE 12, 2006 Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, June 12, 2006 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann Jane Daggett, Secretary John Coldiron, Building Inspector/Zoning Officer Frances Reyburn, Historic Commission OTHERS: Scott Rugen Nate King Sam Reyburn Jim Fritsch of Regester Assoc. Steve Donnelley John Bradley Karl Herr Bill Schoell Robert Yoder After the Salute to the Flag, Betsy Huber led in prayer. PUBLIC COMMENTS - At this time, public comments were asked for based on the agenda. There were no comments at this time. MINUTES - Motion was made by Charles Fleischmann, seconded by Betsy E. Huber and carried to approve the May 1, 2006 Special Meeting Minutes and the May 8, 2006 Meeting Minutes. Gordon - Yea Huber - Yea Fleischmann - Yea KATHLEEN JEFFORDS - 2 Lot Final Subdivision Plan on Newark Road. This plan was presented by Jim Fritsch of Regester Associates. Mr. Fritsch came before the Supervisors to request four (4) waivers from the subdivision ordinance and also to request approval of this plan with contingencies. The township has not yet received approval and review from Chester Co. Health Department. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the following waivers: Section 501.K.l.b Requiring 5 foot contours Section 501.K.5 Requiring steep slopes to be delineated Section 501.K.6 Requiring location of trees 6 inches or greater Section 501.K.7 Requiring the location of wetlands and also to approve the 2 Lot Final Subdivision Plan of Kathleen Jeffords, Job #29624 contingent upon receiving the Form B - Non-Building Waiver from Chester County Health Department. Gordon - Yea Huber - Yea Fleischmann - Yea The subdivision plans will be signed at a later date. HICKMAN/HERITAGE - 2 Lot Final Subdivision Plan on Baltimore Pike. These plans were approved by the Board of Supervisors on May 8, 2006 with contingencies. The township has received the Form B - Non-Building Waiver from Chester County Health Department. Therefore, the plans were signed by the Board of Supervisors. Upper Oxford Township June 12, 2006 Page 2 BRENDAN DOUGHERTY - 2 Lot Final Subdivision Plan on Kimble Road. This review was processed by Lower Oxford Township since most of the property was located in Lower Oxford. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve and sign the Brendan Dougherty 2 - Lot Final Subdivision Plan, Project No. 0534. Gordon - Yea Huber - Yea Fleischmann - Yea WILLIAM AND MARGARET SHAW/CHADDS FORD BUILDERS - 37 Lot Preliminary Subdivision Plan on Newark Road. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to accept and grant a 90 day extension for the Shaw/Chadds Ford Builders Subdivision. (this extension will expire 9/30/06.) Gordon - Yea Huber - Yea Fleischmann - Yea BAINBRIDGE/WIGGINS/MEGILL - 16 Lot Preliminary Subdivision Plan on Pusey Mill Road. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to accept and grant a 90 day extension for the Wiggins/Megill Subdivision. (this extension will expire 9/30/06) Gordon - Yea Huber - Yea Fleischmann - Yea LINDA PIERCE - 2 Lot Final Subdivision Plan on Pennsgrove Road. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to accept and grant a 90 day extension for the Linda Pierce Subdivision. (this extension will expire 9/30/06) Gordon - Yea Huber - Yea Fleischmann - Yea CONSTANCE BIDDLE/GARY CALIBEY ESCROW ACCOUNT - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve Release #10 in the amount of $10,070.00 from the Gary Calibey Escrow Account based upon recommendation of the township engineer, Ragan Engineering for work performed. Gordon - Yea Huber - Yea Fleischmann - Yea ZONING AND BUILDING INSPECTION - John Coldiron read his zoning and building inspection reports for the months. John also discussed with the Supervisors the possibility of having residents acquire permits for setting off fireworks. Concerns are enforcing such permits. Notices regarding fireworks could be placed in the township newsletters in the future. HISTORIC COMMISSION - Frances Reyburn reported that since the historic maps were not completed, Jane Davison hopes to attend the Board of Supervisors July meeting. ROADS - A written report was received from the Road Master. EMERGENCY MANAGEMENT COORDINATOR - A written report was received from Emergency Management Coordinator. PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the payment of bills in the amount of $26,400.00 from the State Fund, $1,233.35 from the Open Space Fund and $36,349.33 from the General Fund. Gordon - Yea Huber - Yea Fleischmann - Yea Upper Oxford Township June 12, 2006 Page 3 UNPAID PER CAPITA - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to turn the list of unpaid Per Capital Taxes to Berkheimer for collection. Gordon - Yea Huber - Yea Fleischmann - Yea ROAD CONSTRUCTION - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt Resolution #2006-5, Road Construction Projects using liquid fuel money. Gordon - Yea Huber - Yea Fleischmann - Yea RETTIG ZONING HEARING - has been postponed until a later date. The Supervisors will take a position on this at a later meeting . Supervisor Charles Fleischmann presented a letter recusing himself from any decisions or votes regarding the Rettigs. (see attached letter) GOLDER ZONING HEARING - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to instruct the township solicitor to uphold the zoning ordinances of Upper Oxford Township seeking relief from Section 1806.4 of the ordinances, at the Golder zoning hearing. Gordon - Yea Huber - Yea Fleischmann - Yea ROBERT YODER - Items of discussion are as follows: · Township has little accommodating hours, employees have a responsibility to be at the township building, Secretary should have Friday evening office hours · Staples Business Center can make copies for $ .05, $ .07, $ .08; Upper Oxford Township charges $ .50, he feels that $ .50 is way out of line. He is still searching for a copy of the “Oath of Office” Responses are: · Copies of the minutes and various meeting dates along with office hours will be posted on web site · When considering costs of copies, cost of machine, repairs, toner, drums, paper, employees time should all be taken into consideration. Staples Business Center has a different set-up than the township District Justice Farmer should have a copy of the Oath of Offices. Frances Reyburn pointed out to the Board and audience that the Court House charges $ .50 for copies. Karl Herr voiced his concerns regarding Mr. Yoder’s questions. He also stated that the township is not in the business to do copying and he feels that the township hours are adequate. PUSEY MILL ROAD SPEED ORDINANCE - Jim Gordon explained that next month, the ordinance to adopt speed limits on Pusey Mill Road will be ready. Speed Limit will be 35 MPH to 4-way stop and then will be 30 MPH to bridge.
