UPPER OXFORD TOWNSHIP JULY 12, 2006 Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, July 10, 2006 at 7:00 P.M. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann (arrived at 7:10) Jane Daggett, Secretary Tom Guhl, Roadmaster John Coldiron, Building Inspector/Zoning Officer Frances Reyburn, Historic Commission OTHERS: Nate King Fran and Frannie Sharon Harold Bryson Paul Brousseau Anita & Herb Bowersock John Bradley Bill Schoell Alice Fling Steve Donnelley Joe Sexton Ann Lambert After the Salute to the Flag, Jim Gordon led in prayer. PUBLIC COMMENTS - At this time, public comments were asked for based on the agenda. There were no comments at this time. MINUTES - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve the June 12, 2006 Minutes. Gordon - Yea Huber - Yea Fleischmann - Absent KINGS MILL I - 32 Lot Preliminary Subdivision Plan on Newark Road. Motion was made by Betsy Huber, seconded by Jim Gordon and carried to accept and grant a 90 day extension (until 10/11/06) for the Kings Mill I Subdivision Plan. Gordon - Yea Huber - Yea Fleischmann - absent TURNERS POND MAINTENANCE GUARANTEE - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to release the Turners Pond Maintenance Guarantee Closure based upon recommendations of the township engineer, Ragan Engineering. Gordon - Yea Huber - Yea Fleischmann - Yea GARY CALIBEY LETTER OF CREDIT - This release of escrow funds was approved last month, therefore the letter of credit needed the signatures of the Supervisors. ZONING AND BUILDING INSPECTION - John Coldiron read his zoning and building inspection reports for the month. ROADS - Tom Guhl read his report for the month. Upper Oxford Township July 10, 2006 Page 2 PAYMENT OF BILLS - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the payment of bills in the amount of $46,010.36 from the General Fund and $357.63 from the Open Space Fund. Gordon - Yea Huber - Yea Fleischmann - Yea RESOLUTION #2006 - 6, FEE SCHEDULE - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt Resolution #2006 - 6, setting a new fee schedule for the township with the following changes: Page 2, Inspection Fees - “As per required for any structure that needs a permit, when permit is obtain, the Zoning Officer will inform resident how many inspections are required, as a minimum.” Gordon - Yea Huber - Yea Fleischmann - Yea ORDINANCE NO. 2006 - 4, SPEED LIMIT ORDINANCE - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt Ordinance No. 2006 - 4, establishing a reasonable and safe maximum speed limit for Pusey Mill Road. Gordon - Yea Huber - Yea Fleischmann - Yea CHESTER COUNTY CHALLENGE GRANT AND FUNDING CERTIFICATION - Motion was made Betsy Huber, seconded by Charles Fleischmann and carried to sign the Certification of Township Matching Funds For Chester County Challenge Grant Program For 2006 Program Year in the amount of $40,000.00. Gordon - Yea Huber - Yea Fleischmann - Yea ZONING HEARING BOARD MEMBER - Motion was made by Jim Gordon, seconded by Betsy Huber and carried to appoint Edward E. Hook as Zoning Hearing Board Member for the remainder of a three (3) year term which will expire January 2008. Gordon - Yea Huber - Yea Fleischmann - Yea PLANNING COMMISSION MEMBER - Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to appoint Betsy E. Huber as Planning Commission Member for the remainder of a six (6) year term which will expire January 2007. Gordon - Yea Huber - abstained Fleischmann - Yea PAUL BROUSSEAU - questioned the Supervisors regarding the sale of the Empie farm on Pusey Mill Road and the possibility of the farm becoming a mushroom farm. The Supervisors informed Mr. Brousseau and the audience mushroom farming is agricultural and would be an allowable use. ANITA BOWERSOCK - questioned the Supervisors on the Kings Mill Subdivision and where the drip irrigation system would be located. Also questioned the Supervisors on the Empie farm and mushroom farming. Supervisors Charles Fleischmann explained to Mrs. Bowersock the new zoning ordinance and regulations on subdividing a thirty or more acre parcel. SUPERPAVE - Supervisors discussed the new Penn Dot regulations and will request the Solicitor to draw up language to accommodate these new regulations into our present ordinance book. CABLE TV - No news regarding the contracts. Upper Oxford Township July 10, 2006 Page 3 BILL SCHOELL - questioned the time of the Golder zoning hearing which will be held July 20, 2006 at 7:30 P.M. Mr. Schoell also discussed with the Supervisors, impact fees and if the township would be interested in him researching information regarding impact fees. ADJOURNMENT - There being no further business, motion was made by Betsy Huber, seconded by Charles Fleischmann and carried unanimously to adjourn at 8:15 P.M.
