UPPER OXFORD TOWNSHIP

OCTOBER 9, 2006

 

Upper Oxford Township Board of Supervisors held a special hearing at the township building, 1185 Limestone Road, Russellville, PA on Monday, October 9, 2006 at 6:45 P.M.

 The purpose of the hearing was to hear comments regarding Flood Plain Ordinance amendments.  Proof of publication was on hand along with a copy of the ordinance.  There were no comments regarding this amendment.

 

The regular meeting commenced at 7:00 P.M.

After the Salute to the Flag, Betsy Huber led in prayer.

 

PUBLIC COMMENTS - At this time, public comments were asked for based on the agenda.  Mr. Yoder had questions regarding 2007 election.  This would be discussed later in the evening.  There were no other comments from the public.

 

MINUTES - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the September 11, 2006 Minutes.

CHARLES AND VIRGINIA FITZGERALD - Approached the Board regarding property which they are considering purchasing from Linda Pierce.  Their daughter would live on the property and Mr. Fitzgerald would house his equipment on the premises.  The zoning officer gave his recommendation which allows this.  This is considered a “use by right” and is permitted.

JOHN R. ST.JOHN - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to allow the St. John 3 Lot Subdivision Plan to become a Final Plan and eliminate the Preliminary Plan process.

MICHAEL PELET/GEORGE KIRIAKIDI (new owner) 11 Lot Final Subdivision on University Road.  Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to accept and grant an extension for the Pelet/Kiriakidi 11 Lot Final Subdivision Plan until October 1, 2007.

LINDA PIERCE - 2 Lot Final Subdivision Plan on Pennsgrove Road - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to adopt Resolution #10-2006 which is the Planning Module for Linda Pierce 2 Lot Final Subdivision Plan.

               Motion was made by Betsy Huber, seconded by Charles Fleischman and carried to approve the 2-Lot Final Subdivision Plan of Linda Pierce, Project No. 0609.

BARTELS/HICKMAN/HERITAGE BUILDING GROUP - This 81 Lot Preliminary Subdivision Plan was discussed by the Board of Supervisors.  After receiving review letters from the township engineer and solicitor it appear that all is in order except for a few conditions that will need to be met before final approval.

 

               Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the Bartels/Hickman/Heritage Building Group 81 Lot Preliminary Subdivision subject to the following conditions:

 

That the Applicant comply with all requirements for final plan approval including but not limited to the requirements for financial security.

 

That the developer and owners agree to cooperate with the proposed Regional Sewage Plan for the Forestville area; and

 

That the developer will contribute to offsite highway improvements at the time of the Penn Dot Highway Occupancy Permit.

Note - This is not a motion to approve sewage facility treatments.

 

PROPOSED SEWAGE TREATMENT FACILITIES - The Board of Supervisors discussed a proposed sewage treatment facility with capacity to include Russellville using the Kings Mill subdivision to accommodate the homes.  The second area considered is the Bartels/Hickman/Heritage - Shaw subdivisions.  The treatment plant will be on the Bartels/Hickman/Heritage property and the sewage will be pumped up from the Shaw area.  Area residents surrounding this property questioned the Supervisors on the

capacity of the treatment plant and what the Supervisors’s based their decision on.  The Supervisors explained that we have been working with a sewage consultant, Castle Valley, to find a feasible solution for the new developments.   A special meeting will be scheduled for Monday, October 30, 2006 at 7:00 P.M. to further discuss sewage proposals.

 

WATCH CHILDREN - Resident Donna Kane submitted a request for the township to place a “Watch Children” sign on Pennsgrove Road, near the church.  The Roadmaster will check into this.

 

ROUTE 896/HOMEVILLE - Resident, Jessica Reyburn presented the Supervisors with a petition from residents along the Rt. 896 corridor and Homeville Road requesting the Board to contact Penn Dot to perform a traffic study.  After a serious accident this past weekend, residents voiced their opinions on the need for additional stop signs or other means to control this dangerous intersections.  The Supervisors will draft and send a letter to Penn Dot requesting a study and also voicing their concerns regarding this area.

 

ORDINANCE NO. 5 - 2006 - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt Ordinance No. 5 - 2006, which is the Flood Plain Ordinance.

JACOB STOLTZFUS/RT. 896 CEMETERY - Mr. Stoltzfus informed the Board of Supervisors of the problem with leaves blowing from the cemetery into his yard.  He would be willing to clean up the leaves if the Supervisors would remove the dirt pile from the cemetery, remove the old stump and also the concrete block.  The Roadmaster will check into this.

 

BUILDING INSPECTOR/ZONING - John Coldiron gave his reports for the month on building inspections and zoning.

 

ROADS - Tom Guhl read his report for the month.

 

EMERGENCY MANAGEMENT - A written report was received from the Emergency Management Coordinator.

 

HISTORIC COMMISSION - The Historic Commission would like permission to join Chester County Preservation Society.  Permission given. 

 

PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve the payment of bills in the amount of $81,134.73 from the State Fund, $196.98 from the Open Space Fund and the amount of $103,480.01 from the General Fund.

 

               Charles Fleischmann reclused himself from voting.

2006 FIRE PROTECTION CONTRACT WITH UNION FIRE COMPANY #1 - The contract will be compared to last year’s contract and acted upon next month.

 

COMPREHENSIVE PLAN - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to send a letter to Chester County Planning Commission requesting them to review our present comprehensive plan and how it can be updated.

VOTER SERVICES - Would like to bring machines to the township November 2, 2006 between 8:00 and 12:00 P.M.  Tom will be available to open the building. 

 

ROBERT YODER - Questioned Supervisor Jim Gordon on whether or not Jim would seek re-election.  Mr. Yoder is also concerned because he cannot hear everything that is said during the meeting.  He suggested buying a PA system.  The Supervisors told Mr. Yoder that they would work on talking more voluminously.

 

EAST NOTTINGHAM TOWNSHIP - Is hosting a work session before their regular meeting on October 19, 2006 at 7:00 P.M. to discuss Sewage Module procedures for minor subdivisions.  All townships are invited.

 

ADJOURNMENT - There being no further business, Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adjourn at 9:00 P.M.
