UPPER OXFORD TOWNSHIP NOVEMBER 13, 2006 Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, November 13, 2006 at 7:00 P.M. PRESENT: James E. Gordon Charles Fleischmann (absent - Betsy E. Huber) Jane Daggett, Secretary Tom Guhl, Roadmaster John Coldiron, Building Inspector/Zoning Officer Frances Reyburn, Historic Commission OTHERS: Scott Rugen Nathan King Joe Sexton Steve Donnelley Wayne Megill Jim Fritsch Alice Fling Bill Schoell Karl Herr Christine Nibouar Robert Yoder After the Salute to the Flag, Jim Gordon led in prayer. PUBLIC COMMENTS - At this time, public comments were asked for based on the agenda. Mr. Yoder requested to be placed on the agenda. MINUTES - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to approve the October 9, 2006 regular minutes, the October 17, 2006 Budget Workshop minutes and the October 30, 2006 Special Meeting minutes. Gordon - Yea Fleischmann - Yea WILLIAM SHAW/MEGILL SUBDIVISION - 37 Lot Subdivision on Newark Road presented by Jim Fritsch and Wayne Megill. The subdivision’s name will be “The Ridings”. This property is on the south side of Newark Road below Baltimore Pike. The proposal is for a 37 lot subdivision, 36 new homes and one existing home. The developer was requesting a waiver of Section 510 K.6 which is the location of trees, 6” caliber or more to be shown on the plans. Mr. Fritsch reviewed our engineer’s letter and the outstanding issues. At the November 6, 2006 meeting of the Upper Oxford Township Planning Commission the commission made a motion to recommend to the Board of Supervisors that this Preliminary Plan be approved based upon all outstanding issues be resolved and satisfied by the township engineer. Motion was made by Charles Fleischmann that we not approve this Preliminary Subdivision Plan until an adequate letter is received from the township engineer. The motion was not seconded. Jim Fritsch then requested an extension thru December 31, 2006 and requested that Castle Valley review the planning modules and respond by the December 11th meeting. Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to accept and grant an extension for “The Ridings” subdivision until December 31, 2006. Upper Oxford Township November 13, 2006 Page 2 PENNS GROVE ASSOCIATES - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to accept and grant a 90 day extension for the Penns Grove Associates/Hartmaier Subdivision for the 11-Lot Subdivision on Pennsgrove Road. Gordon - Yea Fleischmann - Yea PROPOSED 2007 BUDGET - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to adopt the 2007 Proposed Budget. Gordon -Yea Fleischmann - Yea 2007 FIRE PROTECTION CONTRACT - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to sign and approve the 2007 Fire Protection Contract with Union Fire Company. Gordon - Yea Fleischmann - yea ZONING/BUILDING INSPECTION - John Coldiron read his reports for the month. ROADS - Tom Guhl read his report for the month. HISTORIC COMMISSION - Wants to meet with the Supervisors. Will be scheduled for November 28, 2006 at 7:00 P.M. HISTORIC COMMISSION APPOINTMENT - Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to appoint Margaret Hickman to fill the term vacated by Larry Johnson. Gordon - Yea Fleischmann - Yea PAYMENT OF BILLS - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to approve the payment of bills in the amount of $209.57 from the Open Space Fund and $30,559.96 from the General Fund. Gordon - Yea Fleischmann - Yea CHESTER CO. S.P.C.A. 2007 CONTRACT - Motion was made by Charles Fleischmann seconded by Jim Gordon and carried to approve the 2007 Stray Boarding Contract with the Chester Co. S.P.C.A. in the amount of $75.00. Gordon - Yea Fleischmann - Yea STEVE DONNELLEY - Discussed Sewage Facility location with the Supervisors regarding the subdivisions proposed for his area. ROBERT YODER - Questioned Supervisors Gordon on whether or not he would be seeking re-election. - Yes Questioned the Board on whether or not they wanted him to investigate the purchase and installation of a PA system. - No If the township requires a permit to demolish homes and barns. - Yes If Mr. Rettig applied for permits for his property on Homeville Road. - Yes Upper Oxford Township November 13, 2006 Page 3 BILL SCHOELL - Questioned the Board if they are addressing their Act 537 Plan and if the Board gave any thought on the sample ordinances for Impact Fees which he presented to them previously. The Board informed Mr. Schoell that their Solicitor advised against the ordinance as it could be challenged. WATERSHED - Supervisors Fleischmann informed the public that Chester County Conservation District is applying for a grant for watershed programs and are requesting letters of support. Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried that the township write of letter of support to the Chester County Conservation District’s application for an EPA Targeted Watershed Grant Program-Implementation Projects for the Octoraro watershed.
