UPPER OXFORD TOWNSHIP DECEMBER 11, 2006 Upper Oxford Township Board of Supervisors held a Special Hearing at the township building, 1185 Limestone Road, Russellville, PA on Monday, December 11, 2006 at 6:45 P.m. PRESENT: James E. Gordon Betsy E. Huber Charles Fleischmann Jane Daggett The purpose of the hearing was to present and take comments and questions on amending the Comprehensive Plan. There were no comments. The hearing convened at 6:50 P.M. The regular meeting commenced at 7:00 P.M. PRESENT: James E. Gordon Betsy E. PUBLIC COMMENTS - At this time, public comments were asked for based on the agenda. Mr. Yoder requested to be placed on the agenda. MINUTES - Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to approve the November 13, 2006 Minutes. Gordon - Yea Huber - Abstained Fleischmann - Yea MICHAEL PELET/GEORGE KIRIAKIDI - Final Subdivision Plan for 10 Lot Subdivision on University Road presented by Ed Jefferis. After discussion Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve the Michael Pelet Final Subdivision Plan with the following conditions: 1-Correct Note #11 2-D.E.P. review and approval of the planning module 3-Escrow amount approved by the Solicitor 4-Signed and notarized plans 5-Correction of Lot 5 on page 2 of the plan to agree with page 3 of the plan Gordon - Yea Huber - Yea Fleischmann - Abstained JOHN ST. JOHN - 3 Lot Subdivision Plan on Forest Manor Road presented by Ed Jefferis. Mr. Jefferis was seeking approval of the planning module in order to send it to D.E.P. and start their review. Motion Upper Oxford Township December 11, 2006 Page 2 was made by Betsy Huber, seconded by Charles Fleischmann and carried to adopt Resolution #2006 - 11 which is the John St. John Planning Module. Gordon - Yea Huber - Yea Fleischmann - Yea WILLIAM SHAW/MEGILL - This 37 Lot Preliminary Subdivision Plan was presented by Jim Fritsch of Regester Associates. Planning Commission recommended approval with contingencies. This subdivision is now called “The Ridings”. Mr. Megill and Castle Valley are working on the planning modules. After much discussion, Motion was made by Betsy Huber, seconded by Jim Gordon and carried granting a waiver from Section 501.K.6 (caliber of trees) and approving the 37 Lot Preliminary Subdivision Plan of William Shaw/Megill contingent upon items in the townships engineer’s letter of November 13, 2006 being resolved satisfactory. Gordon - Yea Huber - Yea Fleischmann - Opposed WIGGING/MEGILL/BAINBRIDGE - 16 Lot Preliminary Subdivision Plan on Pusey Mill Road. Motion was made by Jim Gordon, seconded by Betsy Huber and carried to grant waivers from Section 613.C.3.D (storm water management), Section 613.C.3.E (plastic pipes) and approve the 16 Lot Preliminary Subdivision Plan of Wiggins/Megill,Bainbridge contingent upon all open items in the township engineers letter being resolved and also the impact study numbers being recalculated and include waiver for storm sewer pipe size and material.. Gordon - Yea Huber - Yea Fleischmann - Yea PENNS GROVE ASSOCIATES/HARTMAIER - 11 Lot Subdivision on Pennsgrove Road was discussed by the Supervisors and the engineer for the applicant. Part of this subdivision is in Lower Oxford Township. The entrance to Upper Oxford Township parcels belongs to Lower Oxford Township. Some details still need to be worked out. Mr. Singla will seek Lower Oxford’s Planning Commission suggestions. VINCENT TALIERCIO - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to grant and accept a 90 day extension for the Vincent Taliercio 2 Lot Subdivision and add-on Plan on Webb Road. Gordon - Yea Huber - Yea Fleischmann - Yea MALLET HILLS - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to grant and accept an extension until March 16, 2007 for the Mallet Hill Estates 77 Lot Preliminary Subdivision on Ewing and Forest Manor roads. Gordon - Yea Huber - Yea Fleischmann - Yea KINGS MILL II - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to grant and accept an extension until February 12, 2007 for the Kings Mill II, 38 Lot Preliminary Subdivision on Newark Road. Gordon - Yea Huber - Yea Fleischmann - Yea JOHN ST. JOHN - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to accept and grant a 100 day extension, which will be until April 10, 2007, for the John St. John 3-Lot Preliminary Subdivision on Forest Manor Road. Gordon - Yea Huber - Yea Fleischmann - Yea Upper Oxford Township December 11, 2006 Page 3 ANTHONY BEILER/EDWARDS PROPERTY - Motion was made by Charles Fleischmann, seconded by Betsy Huber to grant and accept an extension for the Anthony Beiler 5-Lot Subdivision on Limestone Road. Gordon - Yea Huber - Yea Fleischmann - Yea EPHRAIM AND ARLENE HERSHEY - Mrs. Hershey requested the Board of Supervisors to consider taking road dedication of Log House Road. The maintenance agreement and financial security letter from the bank stills need to be given to the township solicitor for approval. Motion was made by Betsy Huber, seconded by Jim Gordon and carried to adopt Resolution #2006 - 14. This Resolution is contingent upon the individuals making the offers coming into full compliance with all of the requirement established by the township engineer and solicitor and will not be effective unless the financial security, the maintenance agreement and as-built plans are submitted to the township solicitor and engineer prior to December 29, 2006. Gordon - Yea Huber - Yea Fleischmann - Yea Motion was made by Betsy Huber, seconded by Jim Gordon and carried to adopt Resolution #2006 - 15, Acceptance of Deed of Dedication. Gordon - Yea Huber - Yea Fleischmann - Yea RESOLUTION #2006 - 12 - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt Resolution #2006 - 12, which amends the township Comprehensive Plan, by adding the Route 896 Corridor Plan as “Chapter 13”. Gordon - Yea Huber - Yea Fleischmann - Yea 2007 BUDGET - Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to adopt the 2007 Budget. Gordon - Yea Huber - Yea Fleischmann - Yea TAX RATE - Motion was made by Betsy Huber, seconded by Jim Gordon and carried to adopt Resolution #2006 - 13, setting the tax rate for 2007 at .5 mills or ½ cent for each $100.00. Gordon - Yea Huber - Yea Fleischmann - Yea ZONING/BUILDING - John Coldiron read his zoning and building inspections reports for the month. ROADS - The Supervisors reviewed the road report for last month. SEWAGE DISPOSAL - Supervisor Fleischmann explained the township has had an offer to provide sewage disposal for the Russellville area. This could be provided for by tying into the Beiler/King Subdivision proposed on Newark Road. Discussion followed with questions from the audience. Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to express the township’s interest in King Mill II Subdivision providing capacity in Kings Mill’s sewage and treatment disposal plant to township use. Gordon - Abstained Huber - Yea Fleischmann - Yea Upper Oxford Township December 11, 2006 Page 4 PAYMENT OF BILLS - Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the payment of bills in the amount of $461.28 from the Open Space Fund and $28,332.05 from the General Fund. Gordon - Yea Huber - Yea Fleischmann - Yea PENN DOT LETTER - The Township received a letter from Penn Dot recommending that stop signs be placed at Homeville Road and Route 896. This is in response from a request from the township. Additionally, a road study was done in 1960 setting the speed limit at 40 MPH. The road will be posted as such. ROBERT YODER - Mr. Yoder questioned Supervisor Gordon on whether he was still seeking re-election, voicing his concerns about serving another 6 years.
