Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, March 12, 2007 at 7:00 P.M.

EPHRAIM AND ARLENE HERSHEY – Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to release the Construction Guarantee Letter of Credit for the Hershey Subdivision.

LINDA PIERCE – Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to release $41,642.99 from the Forestville Business Center Escrow account based upon recommendation of Ragan Engineering.

MINUTES – Motion was made by Betsy Huber, seconded by Jim Gordon and carried to approve the February 12, 2007 Minutes and the February 26, 2007 Minutes.

JOHN ST. JOHN – 3 Lot Final Subdivision Plan presented by Ed Jefferis. Financial Security is still being worked on and we are still waiting for D.E.P. approval.
Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve Resolution #2007 – 3, approving the final subdivision plan submitted on behalf of John R. St.John contingent upon the applicant obtaining satisfactory financial security as approved by the Township.

Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the Two Lot Final Subdivision Plan of Reuben Stoltzfus, Project No. 06103.

CAROL STANLEY – 2 Lot Subdivision on Pusey Mill Road.
Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to grant and accept an extension until June 11, 2007 for the Carol Stanley 2 Lot Subdivision Plan.

MALLET HILL ESTATES/FORTUGNO – 77 Lot Subdivision on Ewing Road.
Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to grant and accept an extension until June 18, 2007 for the Mallet Hill/Fortugno 77 Lot Subdivision Plan.

Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to grant and accept an extension for 90 days for the Vincent Talierco 2-Lot Subdivision Plan.

BINKLEY AND OBER – LAND DEVELOPMENT PLAN – located on Route 10, Limestone Road.
Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to grant and accept an extension for 90 days for the Binkley and Ober Land Development Plan.

KINGS MILL II – 38 Lot Subdivision Plan on Newark Road presented by Laura Swiski.
Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to waive Section 501.K.6 requiring the location of existing trees, provided that no future plans encompass any future development.

Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to permit the construction of a Boulevard Street at the entrance located on Route 896 in lieu of using the typical road cross section as shown in Appendix I.

Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried that developer can build on Class I and II soils and that the main entrance will be located on Route 896 and not Pusey Mill Road.

Laura Swiski informed the Supervisors that the landscape section in the cul de sac will be removed. Supervisors approved the roads names as follows: Colonial Way, Governors Drive and Jamestown Way.
PETTINARO SHOPPING CENTER –
Resident Steve Donnelley stated challenges and opportunities that a shopping center would bring. Mr. Joseph Riper reviewed the amendments that the developer would like the Supervisors to consider in our ordinance:
· Building height – definitions
· Section 901 – use regulations – building not to exceed 40,000 sq. feet (would like this changed to 60,000 square feet
· Section 901-L.6 – more than 1 use
· Section 902-H – paved area
· Section 1101 – slopes
· Section 1302.F - soils
· Section 1405.2 – lighting
· Section 1406.2 – noise controls
· Section 1406.5 – heat and glare
· Section 1407.2 – loading berths
· Page 83 – created shopping center category
· Historic resources
· Signage – Article VII – signs in commercial districts
Supervisor Gordon informed Mr. Riper and Mr. Pettino that they would need to review the requests and also meet with the township solicitor regarding these requests.
Ron Barnum, resident, questioned Mr. Pettinaro on where the entrance will be for the shopping center.
ROADS – The road report was reviewed by the Supervisors.
BUILDING INSPECTION/ZONING – John Coldiron reported on the building and zoning activities for the month.
HISTORIC COMMISSION – Frances Reyburn questioned the Supervisors on the placement of the two fire-proof filing cabinets which are for the Historic Commission use. Supervisors informed the commission that it was best to put the cabinets in the basements. Blair Fleischmann requested assistance with the historic ordinance. She was informed to write down their ideas and the Supervisors would pass them along to the Solicitor to incorporate into our ordinances.
BELL BANK BRIDGE COMMITTEE – Blair Fleischmann and Steve Berkowitz discussed with the Supervisors their goals for the restoration of the Bell Bank Bridge.
Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to send a letter of support to Steve Berkowitz supporting efforts to rebuild Bell Bank Bridge as a covered bridge, but that no municipal funds will be committed.

PAYMENT OF BILLS – Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to approve the payment of bills in the amount of $48,131.12 from the General fund and $1,803.81 from the Open Space Fund.

ROAD BIDS – Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried authorizing the Secretary to advertise for road bid contracts, to be opened May 7, 2007 and awarded May 14, 2007 at 7:00 P.M.

AUDITORS REPORT – The Auditors have completed their report for the year 2006.
CHESTER COUNTY ECONOMIC DEVELOPMENT – Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to send a letter of support for the regional Economic Development Plan.

CAPPELLI – Since the decision of the Zoning Hearing Board is being challenged by Mr. Cappelli, the Supervisor discussed whether P.S.A.T.S. would be willing to get involved. Betsy will contact PSATS.
OFFICIAL MAP – The benefits were discussed on obtaining an Official Map. Charlie will pursue this.
ZONING AND COMPREHENSIVE PLAN – A letter will be written to Chester County Planning Commission requesting their guidance on this project.
PENN DOT MEETING – Charlie gave an update of the Penn Dot meeting with the Shaw developers, Heritage Building Group, Penn Township and Route 896 Task Force that was held March 12th.
LOCAL GOVERNMENT WEEK – Will be April 16 to April 20th. Supervisors agreed to hold an open house of the township’s facilities and equipment on Saturday, April 14, 2007 from 9:00 – 12:00 PM.
CELL PHONES – Jim discussed some available options with Betsy and Charlie.
COMPOSTING CLASSES – No interest.
CHESTER COUNTY TRANSPORTATION IMPROVEMENTS – Letter needs to be reviewed and responded to by April 30, 2007.
Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to apply to the County for township funding to improve the intersection at Route 896 and Baltimore Pike.

ACT 537 – Castle Valley has not done anything as of yet regarding the Act 537.
