Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, May 14, 2007 at 7:00 P.M.

After the Salute to the Flag, Jim Gordon led in prayer.
PUBLIC COMMENTS – Christine Nibouar had questions regarding planning modules, but will wait until Tom Kelso gives his presentation. There were no other comments at this time.
MINUTES – Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to approve the minutes from the regular meeting held on April 9, 2007 and the special meeting held on May 3, 2007.

HERITAGE BUILDING GROUP - On October 9, 2006, the Supervisors approved the Preliminary Subdivision Plan for the Heritage Building Group with conditions which were appealed by Heritage and went before the Courts.
Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried, that the settlement of the appeal by Heritage Building Group of the conditions two (2) and three (3) on the approval dated October 9, 2006, shall be stricken and replaced with the language of the attached form of order, and further authorize Winifred Sebastian, Solicitor, to present the form of order attached to the court for approval to resolve the matter.

LITTLE WASHINGTON – Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried, at the special meeting for May 3, 2007, at which time the Board voted to authorize the filing of a formal protest to Little Washington’s PUC application be vacated.

KINGS MILL II – Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to accept and grant an extension of time, until August 16, 2007 for review of the Kings Mill II Subdivision.

PENNS GROVE ASSOCIATES – Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to accept and grant a 90 day extension for the Penns Grove Associates subdivision. (This extension will expire 8/29/07)

JERED HOOK – Was present and discussed with the Board his preparing for his high school senior project and also his Eagle Scout project. Jered would like to re-construct the township park baseball field. This would include reconstructing the backstop, newly dug out base lanes with a diamond-tex layer, rebuild dugouts/benches and also safety fencing protecting the benches/dugouts. Bluebird boxes, supplied by the township, will be put up around the park. The Supervisors would like Jered to check into insurance before starting this project.
CHESTER WATER AUTHORITY – The Supervisors received a letter and plan regarding the placement of hydrants for the Bartels/Hickman tract. The plans will be forwarded to the township engineer and also the Union Fire Company for review.
CASTLE VALLEY – Tom Kelso was present to discuss with the Supervisors the necessary steps required in planning and updating the Act 537 Plan. Tom discussed the benefits of working with Little Washington in regard to the Bartels/Hickman tract. Tom presented a draft of a portion of the Act 537 Plan updated which will focus on the Forestville and Russellville area. The draft plan evaluates the current wastewater proposal for Kings Mill subdivision, Mallet Hill subdivision, Bartels Hickman subdivision and the Shaw tract. The draft also addresses the issues and evaluates the need for an on-lot management program within the township. Meetings have been scheduled for June 25th and July 23rd to begin working together on this draft plan.
ROAD SPECIFICATIONS – The Planning Commission made a recommendation that the Board of Supervisors adopt a Subdivision Ordinance changing their road specifications to adhere to Penn Dot specifications.
Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to instruct the Solicitor to advertise for the subdivision ordinance amendments.

BLACK TOP – Since the township did not receive any bids for black top in May, the black top will need to be re-bid. Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to advertise for black top, to be opened June 4, 2007 at 7:00 P.M. and be awarded June 11, 2007 at the regular meeting.

ROAD CONTRACT BIDS – Sealed bids were received and opened May 7, 2007 at a special, advertised meeting. The results of the bids are as follows: Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to award the following:

ZONING/BUILDING – John Coldiron read his zoning and building inspections report for the month.
ROADS – Tom Guhl read his road report for the month.
PAYMENT OF BILLS – Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to approve the payment of bills in the amount of $657.22 from the Open Space Fund and $37,941.25 from the General Fund.

Jim informed the audience that Upper Oxford Township along with the neighboring townships have agreed to donate $5,000.00 each to the Union Fire Company Ambulance Division so that they may purchase new stretchers.
UNPAID PER CAPITA – Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to turn the 2006 Unpaid Per Capita taxes to Berkheimer for collection.

AGRICULTURAL PRESERVATION – Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to notify the County that the 2005 year for the preservation easement be closed.

OXFORD AREA MULTI MUNICIPAL – Motion was made by Charles Fleischmann, seconded by Jim Gordon and carried to participate in the multi municipal planning process in the Oxford Area School District.

ED HOOK – questioned the Supervisors on the possibility of eliminating per capita tax or rolling over the tax to park money. Also, Ed wanted to know if we had any regulations regarding land fills. Township will research this.
