Upper Oxford Township Board of Supervisors held their regular monthly meeting at the township building, 1185 Limestone Road, Russellville, PA on Monday, August 13, 2007 at 7:00 P.M.

After the Salute to the Flag, Betsy Huber led in prayer.
PUBLIC COMMENTS – Elizabeth Randolph previously submitted a proposal to the Board for their review regarding Land Trusts for the Fortugno property. The Board will review and comment on this at their August work session. Alice Fling spoke regarding having sprinklers and fire exits in any shopping centers which could be built in Upper Oxford.
MINUTES – Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the July 9, 2007 Minutes and the July 16, 2007 Minutes with the following change:
Page 2, last paragraph: Delete – “after encouraging support from the audience”

WIGGINS/BAINBRIDGE PLANNING MODULE – 16 Lot Subdivision on Pusey Mill Road. The module was reviewed by the Planning Commission in June. We recently received Chester County Health Department approval.
Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to adopt Resolution #2007 – 7, approving the Wiggins/Bainbridge Planning Module.

WIGGINS/BAINBRIDGE/MEGILL FINAL SUBDIVISION PLAN
Motion was made by Jim Gordon, seconded by Charles Fleischmann and carried to accept and grant an extension until September 30, 2007 for the Wiggins/Bainbridge Final Subdivision Plan.

SHAW/RIDINGS/MEGILL PLANNING MODULE – 37 Lot Final Subdivision Plan on Newark Road. This module has been given recommendation by Castle Valley Consultants to forward the module to DEP for review. We received approval from Chester County Health Department also.
Motion was made by Betsy Huber, seconded by Jim Gordon and carried to adopt Resolution #2007 – 8, which is the Shaw Planning Module.

SHAW ROAD NAMES – The two road names, Devon Lane and Horseshoe Circle have been rejected by the County 911. Mr. Megill will try to come up with some new names.
MALLET HILL ESTATES/FORTUGNO –
Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to accept and grant an extension for the Mallet Hill Estates Preliminary Subdivision Plan until December 14, 2007.

PENNS GROVE ASSOCIATES – 11 Lot Preliminary Subdivision on Pennsgrove Road
Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to accept and grant an extension for the Penns Grove Associates Preliminary Plan for 90 days, which will be November 27, 2007.

PETTINARO SHOPPING CENTER – The proposed zoning changes to allow a shopping center were discussed. Recommendations were received from Upper Oxford Township Planning Commission to go forward with the changes. Areas of discussion were the size of the principal building, size of the two secondary buildings, size of the remaining buildings, signage, impervious coverage, and foot candles. The Supervisors agreed that only one principal building not to exceed 55,000 square feet shall be permitted, two secondary buildings, not to exceed 40,000 square feet and all remaining buildings, not to exceed 30,000 square feet. Signage will be in a separate ordinance. Maximum paved area will be changed to 75% and foot candles will be .4 to 1.5 foot candles, lighting at all boundary lines except at the right of way of all abutting public streets shall not exceed .4 foot candles.
Motion was made by Betsy Huber, seconded by Jim Gordon and carried that the proposed amendments will be sent to the Chester County Planning Commission and the Upper Oxford Township Planning Commission after re-writing by the township Solicitor.

SNOW CONTRACT – The 2007/08 snow contract was reviewed by the Board of Supervisors. No action was needed to be accepted.
AG SECURITY ADDITIONS – Petitions were received from Stephen S. and Sadie Mae Fisher, Tax Parcel #57-08-29.01 and #57-08-30.04, to add 50.6 acres; Richard, Porcia and Dennis Breckbill, Tax Parcel #57-07-18, to add 48.2 acres and Melvin and Arlene Horst, Tax Parcel #57-7-16, to add 64.1 acres to the present agricultural security district. The Supervisors will postpone action for 180 days after which time the additions will be automatically approved.

ZONING/BUILDING INSPECTION – John Coldiron read his reports for the month.
ROADS – Tom Guhl was not present, however, Supervisor Gordon read the road report for the month.
PAYMENT OF BILLS – Motion was made by Betsy Huber, seconded by Charles Fleischmann and carried to approve the payment of bills in the amount of $491.61 from the Open Space Fund, $43,054.76 from the State Fund and $35,271.45 from the General Fund.

LITTLE WASHINGTON – An Oversight Agreement between Little Washington Wastewater Company and Upper Oxford Township has been received from Castle Valley Consultants. Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to forward the Oversight Agreement to the township Solicitor for review.

MULTIMUNICIPAL PLANNING – Motion was made by Charles Fleischmann, seconded by Betsy Huber and carried to forward a copy of the Intergovernmental Cooperative Planning Agreement For The Oxford Region to the township Solicitor for review and comments.
